chopper 5 with a live look at 580. we see traffic stacked up at the altamont pass. back to you. >> thank you. >>> san jose about to get a new police chief and it is not anthony batts. now that the position has been filled, what is next for oakland's top cop? let's go to anne makovec. she's in oakland this morning with more on chief batts' next move. anne, good morning. >> reporter: good morning. there's a lot of uncertainty because it's in the even official as far as the appointment down in san jose. chief anthony batts has been here in oakland for one year. he served one year of a three- year contract and then made kind of a shocking announcement a couple of weeks ago. according to the mayor all needs do is give notice, he is not legally bound by the contract. he announced that he was a finalist for the gig down in san jose. yesterday the statement came out that he did not get the job. san jose city manager is said to have picked acting chief chris moore instead. the city council in san jose could approve her choice as early as next week. but that's not final yet.
