let's talk about david axelrod. asked him, what did he think a republican takeover of the house would mean. he said, well, he doesn't think it's going to happen but he would hope it would lead to cooperation. do you think it would lead to cooperation or should we expect more gridlock, more opposition? >> i think there will be areas where there's cooperation. areas where there's opposition. look, the republicans if they take control of the house and get very close in the senate are going to try to put the brakes on all this reckless spending. we just saw this week alone they announced that there was the debt going up $1.3 trillion. by the way partly because 18 billion dollars of stimulus money went to 72,000 dead people. we just saw this week that 95,000 americans lost their jobs and the unemployment rate remains at 9.6%, above 9% for the 14th straight month. we just saw that this administration... we know that this administration has incurred more debt in 18 months than president bush's administration incurred in ei

axelrod, let's just start with the headline news. just when we thought the housing crisis, which was, let us not forget, the beginning of our economic problem-- just when we thought it couldn't get any worse, now we find that this sloppy paperwork by the lenders may have made some of these foreclosures now that are being contemplated invalid. some of the biggest lenders are now freezing foreclosures until they can get all this straightened out. i guess the first question i would have is, does the administration favor some kind of national moratorium on these foreclosures to get this all sorted out? >> first of all, bob, it is a serious problem. it's thrown a lot of uncertainty into the housing market that, as you know, is already fragile. it's bad for the housing market and it's bad for these institutions, which is why they're scrambling now to go back through their documentation for all of this, as they should. the president was concerned enough to veto a bill that came to him last thursday that would have unintentionally made it pe

>> couric: jim axelrod in new york city in times square. jim, thank you. since 9/11, the government has stepped up its background checks on federal workers. today the supreme court heard arguments from a group of nasa contractors who claim investigators are prying too deeply into their personal lives. they want the background checks stopped. tomorrow, the justices take up a landmark case on the outer limits of free speech. the question is whether a church group has the right to protest at military funerals even if many americans find their message outrageous, even hateful. here's chief legal correspondent jan crawford. >> reporter: ever since he was little, matthew snyder wants to be a marine. >> he had a drive to help people, i think. >> reporter: in january, 2006, he was deployed to iraq, just five weeks later, his father's doorbell rang. >> it was two marines and before i even opened the door i knew what they were there for. >> reporter: matthew snyder was dead. the reverend fred phelps and his westborough baptist church took notice. ♪ god hates america

here's national correspondent jim axelrod. >> reporter: world-class open water swimmer fran crippen knewas hot in the united arab emirates saturday. with the air near 100 degrees and water in the upper 80s, maybe too hot to be racing. >> the water was warm; the air was warm and he told me that friday. he said "i'll overhydrate." >> reporter: the 26-year-old died saturday in a race. dehydrated, he slipped under the water a little more than a mile from the finish. the race's referee says crippen drown from exhaustion. three other swimmers were taken from the hospital and even the race's winner, thomas lurz of germany said "it was really just too hot for racing." crippen, who came from a prominent u.s. swimming family, was closing in on his goal to make the olympic team. >> i had this great opportunity ahead of me and i'm looking to seize the moment. >> it was his whole life and he was dedicated to his dream. >> reporter: u.s.a. swimming is calling for a full investigation tonight into the death of fran crippen, including why the boats following the swimmer didn't see him go under. his body
