why we have a yellow alert saturday. >>> but first tonight lawyers for former virginia governor bob mcdonnell say he deserves a new trial. good evening. i'm derek mcginty. >> i'm jan jeffcoat. until today these 32 pages filed by mcdonnell's defense attorneys to push for a new trial because they say the jury was potentially biased. the lawyers claim the jurien constructions were wrong and the u.s. district judge did not properly examine whether jurors were unfairly swayed by news coverage before the trial started and argued the judge should have investigated a claim jurors discussed the trial with each other before they were allowed to. we also learned today one of the jurors was removed because he talked to his personal attorney about the case. he said to his attorney, "there are 12 people and they are kind of all over the place and i don't know what to do." mcdonnell's attorneys pushed for a mistrial then and asked judge spencer to interview the jury, but spencer chose to remove that one juror. legal expert matt kaiser says this file is just to set up motions for an appeal. >> cases like thi
