brett connolly joins us now with the case. brett: prosecutors say the woman was driving home after a race at the daytona international speedway in a pedicab and was raped by the driver. brainerd originally drove around in a confused state, finally the defense plans on presenting a much different view of that night. they claim the alleged victim got into a fight for her fiance that evening and repeatedly offered to have sex with the driver. they say they have additional witnesses that will testify the victim was never held against her will and had no physical evidence of forcible rape. the driver and the victim are expected to testify. if found guilty, he faces up to 15 years in prison. jason: volusia county deputies say someone attacked a disabled man, push into the ground and drove off. deputies were called to a home on floyd avenue monday. the victim' s elderly parents told police their son was using the walker in front of a house. they heard a scream and saw a man pushing down. he was not seriously hurt. michelle: we are get

wesh 2' s brett connolly is here with more on the motion to delay request made by the prosecution this morning. brett: the u.s. supreme court says florida' s death penalty is unconstitutional because a judge rather than a jury determines a death sentence. that ruling causing a dilemma for prosecutors in this case as they seek the death penalty. luis toledo is accused of killing his wife and her two children in october of 2013. their bodies have never been found. the state is asking for capital punishment if toledo is convicted. this morning, prosecutors asked a judge to delay the trial for at least 60 days until the florida legislature can address the issues brought up by the supreme courts ruling. the defense argued against a delay, saying the trial should begin with the only possible penalty now available, life in prison without parole. proceed is so that he can have the death penalty imposed on him. we are trying to defend him. brett: under florida' s now unconstitutional procedure a majority vote of 7 to 5 jurors recommending death was sufficient for judges to impose death. with th

brett: and i' m brett connolly. john lytus took the plea deal a short time ago in a volusia county courtroom. wesh 2' s claire metz is live in claire, this wasn' t the only plea from lytus. claire: the convicted sex offender was charged in a separate case with second degree murder. as part of the negotiation, he pled guilty to that crime as well. 52-year-old john lytus will serve 45 years in prison for all the combined crimes. he pleaded guilty to murdering laura nagengast, whose body was found in a ditch near deland september 23rd. lytus also kidnapped and raped a pregnant woman in daytona beach. though, as part of the plea agreement, the rape charge was reduced to aggravated battery with a deadly weapon. he met that victim at a 7-11, and, once back at his home, hog-tied her in an rv, tortured her with a knife and raped her. she spoke with us and agreed to be identified. >> i just kept praying the whole time. i do not know why it happened, but he let me go. it changed my life. claire: another woman in daytona beach
