this goes back to what justice breyer suggested. part of what we are trying to do here is to maintain a multi- religious society in a peaceful and harmonious way. and every time the court gets involved in things like this, it seems to make the problem worse rather than better. what do you think? >> well, i don't -- i don't think that's true. there are people who distort your decisions. there are people who misunderstand your decisions honestly and -- and innocently. but keeping government neutral as between religions has not been a controversial proposition in this court. and i don't think the fourth circuit has made it worse. they've got a workable rule and the prayers are no longer exclusively christian prayers in the fourth circuit and they have been able to mostly enforce that and there 0 hasn't been litigation at the margins because all the prayers were clearly >> suppose you did this. you combined your two approaches. the town has to -- it cannot -- it must make a good faith effort to appeal to other religions who are in that

justice ginsburg, justice breyer, sotomayor, and kagan. the other justices that sided with scalia were clarence thomas and samuel alito. and even though they did not sign the ruling that the other two justices on the court, justice roberts and justice kennedy also sided with scalia on this ruling. so this was the two sides in this really important texas abortion ruling this week. but look at this breakdown. the side voting to keep the clinics open in texas, those judges were appointed by prp prm, president obama, president clinton, president clinton. the side that voted to shut down the clinics, those justices were appointed by george w. bush, george w. bush, george h.w. bush, ronald reagan, ronald reagan. notice a trend? notice any pattern here? presidents appoint judges. this is one of the fundamental things that presidents do. if you boil presidents down, this is one of the last things left in the pot of gelatinous down there. it is one of the most fundamental and consequential things that american presidents do. it is part and parcel o

justice breyer has fouled a concurring opinion. justice thomas has this occurring in the judgment. >> notice the same lineup but in a but more refracted -- fractured court. justice alito refuses to explain the basis. i am expected to do that in seven minutes? courtssn't he give the holding? because there is no holding. read the opinions, the majority of the court rejects every. that is offered. it talks about the right to be confronted with the witnesses against an individual. they have struggled with the application of that as defined in a cropper case in 2012. -- in the crawford case in 2012 that everything turns in the statement of the testimonial. the court struggled to find that concept to work now in three cases. we know from the first case that a laboratory cannot simply produce a notarized form that and that that can be introduced in evidence in a criminal case for the prosecution. without a witness to lead to aat result dissent by judges that said what the court ought to be doing is in fact not applying normal confrontatio

they also think, and justice breyer said this himself the last time the members of congress go up and argue for their budgets before congress, he said i worry i would change how i act. i would worry about, questions will play on television later and i might censor myself. i might not ask all the questions i was going to ask. finally, justice scalia's favorite objection is that all we're going to see on television is snippets. that is true. i would point out to him that all you see in "the new york times" are snippets. they happen to be in print and have" around them. guess what? they don't all this a transcript of every oral argument. think what they're concerned about is sitting down at home and watching jon stewart pull certain isolated parts of supreme court arguments and making fun of them. i think they're truly worried after the oral arguments in the health care case, republicans put out an ad featuring a solicitor general stumbling. you think this affects the attitudes among members of the court? >> i know it does. i know they were offended by that. but it was terribly unfair an

honor, with respect to some of the things we identify which are similar to the ones that justice breyer recommended, i think our view is they're more akin to safe harbors, that there are undoubtedly advancement challenges that could be brought. and to the extent that the town can point to things such as -- such as public criteria and things like that, that is helpful. with respect to the -- the public forum aspect, i don't think we have a position as to whether it is required, but we do think that that makes this case the much easier case, because of that separation of the one part that is the strongest argument for the other side, that there is an element of coercion, that your application is -- is being ruled on, that the separation the town has adopted makes that much less persuasive. we think the other elements that the respondents have pointed to for coercion are ones that trouble us because they are things that have analogs in our history. so, for example, they point to the presence of children. but, of course, on the senate floor are the senate pages, who are all high school juni
