ktvu's brian flores joins us live from outside of the courthouse in san francisco to explain what was at stake. good afternoon, brian. >> reporter: hey, good afternoon, tori. well, what was at stake today was a civil case. but there was no decision made today here inside san francisco federal court. on the case of johannes mehserle and other officers involved in the shooting of oscar grant during a new year's party a few years ago. now, attorneys for anthony p. eroni and johannes mehserle argued they should be offered immunity because they argued the shooting was an accident. they also say it was tragic but there was reasonable actions by the officers to act the way they did. meanwhile, the attorneys for the victims and four others claim it was not an accident, that they were defenseless and should not be granted qualified immunity of the law. here's what both sides had to say. >> what it means is the simple fact that our rights have been violated. those young men are tie to us as a family -- are tied to us as a family. this an opportunity for the world to see that we do have legal ci

brian flores has more from the reaction of the victims of the frightening crime. good afternoon, brian. >> reporter: good afternoon, tori. we talked to the victims earlier this morning who tell us they are doing fine but obviously shaken up after three robbers barged into their home and tied them up and stole their belongings. the family members did not want to be on camera but we spoke to a father who lives at the home and tells us that a robbery happened at 2:00 a.m. and he was watching tv while his wife was getting ready for work when all of a sudden three robbers forcibly entered their home. according to san francisco police, one of the robbers appeared to have enter nod a side window and -- entered into a side window and opened the door for the other two to enter. once they got in, they pulled out guns and used electrical or duct tape to tie down the residents of the home, the father, his wife, two adult aged kids and a grandmother while they ransacked it. it is unclear if the window was unlocked or forced it open but san francisco police spent most of this mo

ktvu's brian flores is at the sun valley mall in concord and brian, a woman was robbed last night.at happened? >> reporter: hi, dave. we're live here at the sun valley mall. at this hour, concord police are looking for an armed robbery suspect that tried to rob a woman here in front of the macy's parking lot last night here at the mall. from what we understand, the robbery happened again last night around 7:30. it's being -- it's being reported that the woman was arriving here at the mall when the robber pointed something in the back of her head and then demanded that she give them all of her money. the robber pushed her to the ground and then he ran off into what is described as an older model light-colored small car. the victim ran into the macy's and then called police. we talked with some shoppers who heard about the incident. they say they need to be more cautious when they hit the stores. >> it does make me nervous at night and now that there is a lot of thieves going on. a lot of stuff. you know, it's crazy. now, during the holidays. i try to avoid all of that. >> reporter:

it's december 28th i'm brian flores. >> i'm claudine wong. pam and dave are off today. your time is 6:30. >>> oakland homicide rate for the year is up to 130 after a violent night. three people were killed in two separate incidents pap double shotting and -- two separate incidents. a double shooting and a stabbing. >> reporter: a man with cuts to his hands has been taken into custody. police are also trying to cuttrack down a second man for questioning. the man that may have been here when the killing took place. investigators still out here on scene. we're in the 5800 block of walnut street. up here is where officers found a man excuse me a woman stabbed to death inside a unit up on the second floor. police showed up here around 2:30 this morning when neighbors called 911. officers came here and found this woman with multiple stab wounds. she was dead here on scene. sergeant told me police did take that man into custody. he will be questioned by investigators. at this point a sergeant told me a motive for this killing is unclear. meantime on the other side of the city

ktvu channel 2 reporter brian flores joins us from pleasanton where two of the four robberies happened. brian. >> reporter: the main question is whether all these pharmacy robberies are related. we are live here though in front of a rite aid off the 2800 block here in pleasanton. this particular location was robbed around 12:30 yesterday afternoon. but there were also pharmacy robberies at a lucky pharmacy location not too far from here around 6:15 last night. there was a third attempted robbery that may or may not be related that happened a the the 7400 block of dublin boulevard in dublin around 12:40 yesterday. and now we are hearing there was a fourth attempted robbery at a cvs around 5:30 yesterday. a man or men walked up to the pharmacist with a demand note stating he had a gun and wanted some type of opiate based narcotics. when the pharmacist said no the man fled on foot. who police are looking for this morning is either a white or middle eastern man with a beard in his mid 30s around 5'3" and 150 pounds. and another man 5'7" and 200 pounds. we are live in pleasanton i'm brian f

ktvu's brian flores is out at a facility in san francisco now. how busy is it out there, brian?> reporter: well, dave, i mean you hit it on the head. 200 packages per second. 19million packages that will be sent from thanksgiving all the way through the las holidays. go ahead and take a look for yourselves. things are definitely busy here at one of the fed-ex facilities here. and to talk more about how busy it is, let's bring in the operations manager. i mean, talk to us about how busy it is out here. it's really busy? >> yes. everything has been busy. we haven't seen a slowdown. things have been good. all of the employees are here. its all hands ondeck. we have had 110 to 120 employees here this morning. and then later on we'll have 200 employees here to get the packages out in the afternoon. >> reporter: why are you expecting the biggest shipping day today? >> we see an increase in online shop -- we've seen an increase in online, things bought over the internet. things have increased area thanksgiving. we just did a huge increase. >> one of the biggest questions i get -- is it

ktvu's brian flores is there, too. what are they so eager to buy, brian?> reporter: well, dave, you know what, first off, when you go out there shopping today, you need to be patient especially when it comes to hot- ticket items. and here at the newpark, the hot ticket item was the jordan shoes and that just spilled over to tension seen this morning. now, chopper 2 was over the scene when it happened. there was a confrontation among those waiting in line for the shoes. from what we understand, a particular shoe store called sheik was to hand out raffle tickets. the policy was first come/first served but when someone came out to hand out those tickets, a huge crowd yam bushed that person and that's how the you are cause started -- how the ruck cause started. there were -- ruckus started. there were police surrounding the area. they are letting some people in the shoe store right now, from what we understand. >> i just came to get the shoes for my girlfriend. but now -- can't do it now. jordans everybody would do anything for some jordans but back in the day

brian flores, ktvu channel 2 news. >>> 8:35.ding three firefighters still in the hospital this morning after a very serious crash in orinda. it happened yesterday morning on eastbound highway 24 near wilder road. it all started with an suv after crashing in the center divide. while one of the drivers and three firefighters were standing on the right shoulder. another suv lost control and pushed another car into them. all of them were rushed to the hospital with major injuries. >>> that big weekend storm brought a lot of problems to the south bay and utility workers and law enforcement worked overtime. a man, a woman and a child were stuck in that car after flooding on east capitol on mantague expressway. people are pumping water out of parks. a lot of people living in milpitas started to stock up an sand -- on stand bags. >> you know how storms are, they are very unpredictable. i think we're in good condition to tackle the next storm. in mountain view, a tree tapled down in the apartment. there -- toppled down in one apartment.

the justices are meeting in conference right now and brian flores is in the castro district with what we might hear from the high court today. >> reporter: we're expecting some type of action from the u.s. supreme court on proposition 8 which is the state ruling on same-sex marriage. there may be no action at all. this is a similar situation what wee saw on monday where the justices -- we saw on monday where the justices were deciding the case. the first decision, they could refuse to lower the ruling and that would mean that prop 8 is illegal and then gay marriages could happen next week. the second, the court could decide to hear the case and if that happens, a ruling could come by -- could come by june next year and then any action would be put on hold until further notice. as we take it back out here live, we'll keep you updated on the situation and we'll get any reaction if any ruling is done, brian flores, back to you. >>> john boehner says he wants to negotiate directly with president obama. he has asked that senate leaders and house minority leader nancy pelosi be excluded fro

ktvu's brian flores is at the scene along jer raw lin road -- ger raw -- jeralyn road. what happened, brian? >> reporter: we are and out the 63 -- we're on the 6300 block of jeralyn. there is a lot of damage to the back of the house. we just finished talking with the homeowner a few minutes ago. he's lived in the home for 17 years by himself. he says he was sound asleep at midnight. he woke up to his home completely blanketed and choking. he said it was so intense, he barely made it out alive. he said he believes the fire started in the kitchen but unsure how. he was treated for smoke inhalation but he's back home arresting -- resting. here's what he said. >> i'm so thankful that i'm alive. >> the center of the investigation, we'll -- we're having more witnesses and we'll investigations and we'll find out the cause of the fire. >> reporter: he ran to a nearby denny's to call for help, the homeowner said. he arrived back at 6:00 this morning still shaken up. the homeowner said there's significant damage. he said it could have been much worse. we're live in richmond, nine
