bruce leshan is live in charlottesville waiting for their verdict. what's the latest, bruce? >> anita, just about an hour ago, the bailiff went back, asked the jurors how they were doing. they said that they were progressing fine, said check back in an hour. right about now at 6:00, we'll let you know what the response is to that. here's the scene a little bit. a ton of media here to broadcast the verdict when it comes down. we have a lot of cameras here, satellite trucks and you can see the cameras across the street preparing to get people out of the courthouse. we aren't sure if they are going to talk because this jury is going to go into penalty phase if it convicts george huguely of any of these crimes. now they have had a couple questions for the judge. the first one was a question about some jury instructions that they suggest might be contradictory about intent and about causation of death. they also asked about a letter that was left out. the letter from george huguely to yeardley love and which he apologized for an earlier violent incident and promised to stop drinki

bruce leshan has a look at that and some surveillance video. bruce. >> reporter: yes, mike, the video is really quite interesting, but it's not clear how much weight that jury is going to assign to it. it shows george huguely and yardley love together, just the night before her death. the sometime boyfriend and girlfriend caught in a twisted, sometimes violent relationship fueled by college drinking are holding hands at a local watering hole. huguely's aunt narrarated the tape for the jury, calling him georgie and pointing out yardley embracing huguely's two young cousins. on cross-examination, the aunt admitted this was a public social event, that the two might be expected to be cordial even if having trouble in their relationship. then there is that laptop we talked about. the prosecutors say it was worth about $250 or more, the defense puts the value at about $100. they put on an expert who said that it's really important because the prosecution has charged huguely with murder in the commission of a robbery and grand larceny, and for it to be

bruce leshan, 9news now. >> and the pathologist managed to cut a big hole in the defense theory that her injuries may have been caused by cpr. no indication of a recognizable sign of what's called reprofusion. that would be the rush of blood back into brain cells that are starved for oxygen. >>> tonight, new information on a police involved shooting that is generating a lot of questions for most of you. as we reported, a culpeper town police officer shot and killed 54-year-old patricia cook in a parking lot. the police say that the officer's arm had been caught in the front window of cook's jeep and shooting in self- defense as she was attempting to drive away. but an eyewitness says the officer's arm was not caught in the window and now we learned from the spokesperson the officer had not turned on his blue light because if he had, it would have been a sign that he was detaining the person. that according to attorney and former fairfax county police officer, ted sibert. if the person is not being detained, she should be free to leave. >> what is he investigating? suspicious person,

bruce leshan has been in the courtroom in charlottesville. a tough day today, bruce. >> reporter: so tough that when the prosecution wrapped up with the lead medical examiner. huguely's lawyers declined to ask him any questions. >> the medical examiner says yeardley love did have traces of a prescription adhd drug in her system. did have twice the legal limit of alcohol in her blood. but he says what killed her were injures to her brain so serious they eventually stopped her heart. it was a bad day for huguely as two neuropathologists detailed those injuries. both describe small bruises and bleeding all over the brain. christine fuller said bruises to her brain near her temples were consistent with either a fall from a height or punch to the head. particularly if the punch was into a wall or the floor. but she said those injuries were too minor to kill her. instead, both pathologists describe bruising and bleeding they found in love's brain stem. the area of the brain that controls your breathing and your heartbeat. they said those injuries we

bruce leshan is live outside the courthouse, yet another dramatic day of testimony. huh bruce? >> it was definitely a dramatic day, anita, and george huguely was not the only one crying. yeardley love's mother appeared to be crying, as one of the jurors. we also got our first look today at yeardley love's bedroom door. the one george huguely allegedly kicked in. >> a crime scene investigator unwrapped the vinyl door and unveiled a huge hole. next to the knob. huguely kicked the door in to get at yeardley and left his dna behind. it was not the door that had yeardley love's family. detectives at first did not tell the former uva lacrosse player that his exgirlfriend was dead. huguely told police he went to yeardley's apartment just to talk. but he says she started screaming and hitting her head against the wall. she was like a fish out of water. i grabbed her and shook her. but i never struck her or hit her or anything. we were wrestling. she may have had a bloody nose. i tossed her on the bed. i may have grabbed her neck, but i never strangled her. then the detectives told hugu

reporter bruce leshan has been there listening and joins us live with what happened in court today. bruce. >> yeah, anita, the medical examiner testified that there were bruises all over yeardley love's body. but what we have yet to hear about is an injury significant enough to clearly be the cause of death. the fact that the injury may be more subtle than that may be what has given george huguely's lawyers an opening to offer alternatives of her death. >> medical examiner told jurors, bruises consistent with smothering, but he found no evidence of asphyxiation and said smothering was not the cause of death. he found bruises all over her body, including around her neck and he described how choking off the artery could slow, even stop the heart. after a brief time it will usually restart, but cut off for long enough and the victim will die. the medical examiner also told jurors he found a bruise on yeardley love's scalp, but no fracturing and on the surface of the brain, only a little bleeding. george huguely's lawyers have suggested love died not because he smacked her head against t

bruce leshan has been covering this story from charlottesville and joins us now. bruce, you were telling us -- earlier that the jury has been on break, coming back at 12:30. bruce, what happened this morning in the case? >> reporter: well, what happened this morning was no witnesses because one of huguely's lawyers is sick, but they are hoping to get started again at 12:30. the judge really desperate to get through this trial. and he told the jury that he really hoped that he would get -- they would get through the majority of the defense's case by the end of today. we could see closing arguments sometime tomorrow. he says he wants to get this case to the jury by the weekend. we might go a little late tonight, though, to get there. >> we have any idea who is on the witness list for the defense should they be able to call this afternoon? >> reporter: welsh they do have to send out a list of people they may call to testify. they don't always call all of them of one person on that list is a chevy chase neurosurgeon named ronald yousinski, a skeptic of shaken baby synd

our 9news now reporter bruce leshan is outside the courthouse with more details, bruce? >> reporter: yeah, j. c., the prosecutor is really trying to paint a picture for this jurors to give them a moment by moment narrative of the response to yeardley love's death. hours after george huguely left her apartment, her roommate discovered yeardley love unresponsive. her mouth taped with dried -- caked with dried blood, her right eye bruised. purple and swollen shut. the first police officer responded told jurors this morning he knew right away this was not an alcohol overdose. he saw yeardley love's battered face and he knew something far more sinister and violent had happened to her. one of the medic who arrived says he tried for more than 24 minutes to breathe life back into her. pulmoening hard on -- pumping hard on her chest about 100 times a minute to no affect. huguely's lawyer asked that medic if all that cpr might have bruised her body and caused her to bleed more. but the medic said while he thought it was possible for cpr to bruise someone, he had never seen it and

bruce leshan has been covering this trial and is live in charlottesville. what are they asking, bruce? >> reporter: well, anita. one of the questions is about the jury instructions, but it is a little bit tough to figure out because the judge so far has declined to put those jury instructions out there publicly where we can look at them and read them and compare them with what we are hearing in the courtroom. it sounds like they are wrestling with exactly what you might expect them to wrestle with. the murder charges. in a question for the court, the jurors suggested that three of the instructions contradicted each other. one dealing with intent, whether george huguely intended to murder yeardley love. the other two apparently deal with causation. the cause of yeardley love's dealt. how she died. even the judge was con feuds about what the jurors are asking. the judge and the lawyers sent the jurors back a note asking them to clarify their question and we have yet to hear back from the jurors on that. >> okay, bruce, also, are they asking for a copy of a let

bruce leshan joins us live with the details. reporter: these incidents apparently date pack to the middle of last year -- back to the middle of last year, but it took a while to run through the rumor mill here at rich around montgomery high school and then eventually the story -- richard montgomery high school and then eventually the story made its way to police. as police put, it spear and one of his track students allegedly engaged in this intense phone relationship over a period of time. police say then in april or may of 2011 he called her. he took her to his home here in rockville twice and twice engaged in sexual intercourse with this 16-year-old one night after the other. police arrested spear today without incident, charged him with two fourth degree sex offenses. >> fourth degree sex offense because the student was 16 years old. the coach was over 21 years of age and he was in a position of authority. reporter: if she had been younger it might be a more significant charge. >> yes. if she had been 14 to 15 years of age,

bruce leshan, thank you. >>> for the first time metro admitted light for the june, 2009 crash that killed nine riders on the red line. that's a surprise since some families are still battling in court for compensation and no one expected metro to accept legal blame. scott broom is live from the scene of that accident in ft. totten to explain. >> reporter: well, those families are still very much involved in this case, gone but not forgotten. you can see the memorial still on the bridge here above the crash scene. let me tell you these families are very unimpressed with this admission by metro. in fact, there's some legal strategists who think this might be a very shrewd legal strategy to cut the emotional legs out from underneath these families' cases. june 22nd, 2009, a train crash that killed nine, that metro and its electronic equipment suppliers now say in new legal filings was undoubtedly their fault. the defendants have informed the court that they will stipulate to liability, that the trials in the remaining plaintiff cases, metro lawyers wrote in a court memo filed this week. >> e

let's start with bruce leshan who is still at his post outside the courthouse in charlottesville tonightuce. >> reporter: yes, anita, a night filled with sadness. sadness all around as the prosecutors said. the night nearly two years ago when yeardley love was killed, the jury now holding george huguely responsible for that. and tonight where this young man was sentenced, a sentence that may keep him in prison until 50 years old. his family, his young cousin coming out of the courtroom in tears. clearly in shock by the verdict and by the sentence. both announced tonight. they had no comment for us. no comment on camera either from yeardley love's family. they said this, we dread looking back on the events of may third, 2010 and pray for the strength to get through each day. time has not made us miss yeardley any less. in fact, quite the opposite. it is truly devastating to wake up each day and realize that she is no longer here. yeardley's contagious smile, kind spirit, gentle touch have left this world, but we know that heaven has an angel like no other. we will continue to keep her spi

bruce leshan is in charlottesville. how did he look today, bruce? >> reporter: kind of nervous, intense, kind of stared out into the audience apparently at his family. they're kind of clustered right behind him. he entered in a loud clear voice not guilty to the charge of first degree murder and to the five other counts against him. after nearly two years in jail george huguely is drawn, thin in a blazer about two sizes too large, his eyes dark around the courtroom. on the uva lacrosse field he carried 209 pounds on his 6' 2 frame. he is nowhere near that now. both his family and the family of victim yeardley love are crowded on opposite sides at the front of the courtroom. yeardley love's mother cried softly in the pink scarf she and other family members are wearing in memory of the young woman so full of promise. her murder in may, 2010 drew international attention. huguely, a young man raised in private schools and privilege to a wealthy old chevy chase family, allegedly admitted to breaking down his ex-girl friend's bedroom door, to banging her
