you're in charge of elections in north carolina. can you give us some examples how if the court ultimately rules in favor of letting republican legislatures, let's say hypothetically but state legislatures take over, elections in north carolina could change? like what's the real risk here? what's the worst-case scenario? >> far and away the biggest issue for north carolina is how we redistrict every decade. the way our democracy is supposed to work is people are supposed to choose the representatives, not the other way around but what our republican legislative leaders have done is abuse the redistricting process to try to cement themselves into power no matter the will of the voters and that is the gravest part of this case because for instance, in the last decade. >> right. >> we had 13 congress people. they drew a map that had ten republicans and only though democrats. the court struck that down as partisan jergerrymandering and 50/50 state, which north carolina is, we elected switch d -- seven democrats and seven republicans. th

because now that south carolina would be third.n the past south carolina has been the decider, right? that's where everybody races to south carolina. you think about george w. bush when he won his way to the nomination. biden last time around where he sealed the deal. they rejected bernie sanders and the other types you mentioned. so is there benefit to being first if you are south carolina? or would you prefer to be the decider? >> well, i mean, i'm sure the folks in south carolina like it. obviously it puts them in a greater position. maybe they'll still be the decider even if they're first. the bigger question from my standpoint would be what does iowa do? under state law they have to be first. new hampshire has to be first. yet on the calendar so everyone understands, the first primary generally cannot be held in a year other than the year of the national convention, which puts it at 2024, which means iowa will have a hard time because they would have to jump into a date which would probably bring them penalties for delegates.

the north carolina supreme court threw out republicans heavily gerrymandered maps.uld be the end of it. but north carolina republicans decided to use the insurrectionists favorite fringe legal theory -- that would be the independence day legislature doctrine -- they say they did not have to listen to their states highest court. they were effectively saying, hey, under our state constitution, the north carolina supreme court has the final say. but under this legal theory, we do not have to listen to the courts, or the governor, or anybody, really. we can do whatever you want, checks and balances be damned. at least three supreme court justices -- alito, thomas and gorsuch -- have already signaled that they are open to turning that theory into legally binding precedent. and that would have massive implications, not just for gerrymandering, but for american democracy on the whole. under a muscular reading of this legal theory, republican controlled legislatures would be the ultimate authority, not just on gerrymandering, but on how elections themselves are decided. the
