good morning i'm cheryl jennings. >>> and i'm kristen sze. we are finding out now about mirkarimi's official punishment after he pleaded guilty to false imprisonment of his wife. >> sergio joins us with the word. >> reporter: in the last few seconds we've heard word that the sentence has been made official. mirkarimi did plead to a lesser charge of false imprisonment of his wife. that is a misdemeanor charge. this was an agreement that was made last monday today is the formal sentencing hearing. here are the terms that we know had been hammered out, according to that formal deal that was hammered out monday. three years probation. 100 hours of community service. 52 hours of domestic violence classes. family counseling and the stay away order that is currently in effect will stay in effect, at least until he completes the last two components of this sentence. we are expecting to have a statement from the sheriff shortly after this hearing. we've been told going to be making a few statements following the hearing. we also know that the district

i'm cheryl jennings. >> and i'm kristen sze what this plea deal means. >> reporter: this came about as they were starting jury selection in the domestic violence case. sheriff ross mirkarimi has to come back to the hall of justice two more times one to be sentenced monday in the plea and another to ask a judge to lift the stay away order that keeps him from his family. but the criminal case is over. mirkarimi left court after pleading guilty to a misdemeanor count of false imprisonment, involving his wife eliana lopez. cy charged with domestic violence, battery and child endangerment, after a confrontation on new year's with his wife. those charges about drop as part of the plea. mirkarimi faces a sentence of three years probation, 100 hours of community service, 52 weeks of domestic abuse and family counseling and he has to apologize to the court. >> this plea allows us to move forward, as i have i tend to return to the business of running one of the finest sheriff's department in this nation: of mending my family and raising my son in a safe and happy home. >> we are pleased with the

i'm cheryl jennings. >> and i'm kristen sze what this plea deal means. >> reporter: this came about as they were starting jury selection in the domestic violence case. sheriff ross mirkarimi has to come back to the hall of justice two more times one to be sentenced monday in the plea and another to ask a judge to lift the stay away order that keeps him from his family. but the criminal case is over. mirkarimi left court after pleading guilty to a misdemeanor count of false imprisonment, involving his wife eliana lopez. cy charged with domestic violence, battery and child endangerment, after a confrontation on new year's with his wife. those charges about drop as part of the plea. mirkarimi faces a sentence of three years probation, 100 hours of community service, 52 weeks of domestic abuse and family counseling and he has to apologize to the court. >> this plea allows us to move forward, as i have i tend to return to the business of running one of the finest sheriff's department in this nation: of mending my family and raising my son in a safe and happy home. >> we are pleased with the

i'm eric thomas in for cheryl jennings. >>> and i'm kristen sze. david louie is live at the police command center. >> reporter: as you can see behind me the san jose police have an inter section barricaded blossom avenue at blossom hill road. behind the police cars the s.w.a.t. team believe they are keeping an eye on a house where a suspect may be inside. someone who they are definitely trying to capture. neighbors tell us the house is vacant not visible from our advantage point. the suspect is thought to be involved in a carjacking and possible robberies in the south san jose neighborhood. there's an elementary school inside the roped off area, earl frost. students have been instructed to stay in classrooms. the elementary is part of the oak grove school district it has classes from kindergarten through 7th grade. we spoke to a resident who lives a few houses down from where the suspect may be hiding. >> this is normally very quiet. within the last month we've had the bank robbery, now this >> reporter: what is your concern now? >> i just want to

good morning i'm cheryl jennings. >>> and i'm kristen sze. we are finding out now about mirkarimi's official punishment after he pleaded guilty to false imprisonment of his wife. >> sergio joins us with the word. >> reporter: in the last few seconds we've heard word that the sentence has been made official. mirkarimi did plead to a lesser charge of false imprisonment of his wife. that is a misdemeanor charge. this was an agreement that was made last monday today is the formal sentencing hearing. here are the terms that we know had been hammered out, according to that formal deal that was hammered out monday. three years probation. 100 hours of community service. 52 hours of domestic violence classes. family counseling and the stay away order that is currently in effect will stay in effect, at least until he completes the last two components of this sentence. we are expecting to have a statement from the sheriff shortly after this hearing. we've been told going to be making a few statements following the hearing. we also know that the district
