good morning i'm terry mcsweeney in for cheryl jennings. >>> and i'm kristen sze. david louie has just arrived at the scene. >> reporter: as you can see this is an active investigation scene. we are at -- there's a bus shoulder behind me where a person was standing waiting for a vta bus when a late model audi going eastbound on california lost control and struck the person waiting in that bus shelter. down the street you can see what remains of the audi. it traveled a little distance perhaps another 500 feet or so then ended up on the curb. the person who was in the bus shelter has been confirmed as a fatality. person who was behind the wheel of the car, that person has been injured and is at a local hospital undergoing treatment there were multiple witnesses. police are in the process of trying to get as much information as possible. we can see an overview of the situation. the police and fire department have a three to four block area cordoned off. these streets will cause diverses for the next four hours -- diversion for the next four hours will they are able to

good morning i'm cheryl jennings. kristen sze is off today. let's get to terry mcsweeney he's been following the dispute between kincade's girlfriend and estranged wife. >> reporter: the question has to do with a piece of . did kincade write on this piece of paper, a -- a partial will and hand it to his live-in girlfriend? that's the question. that girlfriend was in court this morning. take a look at her this is amy pinto walsh. the woman who lived with thomas kincade for a year plus until his death a couple months ago in april. kincade known for his wildly popular paintings died of alcohol and valium poisoning. she says he left her a piece of paper handwritten that reportedly says she should get 10 million dollars, plus the mansion. kincade's estranged wife says pinto walsh is a gold-digger and the case should not be in open court in any case rather in arbitration to keep it private and protect kincade's recommendations on his reputation. pinto's attorney says otherwise. >> we need to let the judge make his decision that's the only fair thing

good morning i'm terry mcsweeney in for cheryl jennings. >>> and i'm kristen sze. david louie has just arrived at the scene. >> reporter: as you can see this is an active investigation scene. we are at -- there's a bus shoulder behind me where a person was standing waiting for a vta bus when a late model audi going eastbound on california lost control and struck the person waiting in that bus shelter. down the street you can see what remains of the audi. it traveled a little distance perhaps another 500 feet or so then ended up on the curb. the person who was in the bus shelter has been confirmed as a fatality. person who was behind the wheel of the car, that person has been injured and is at a local hospital undergoing treatment there were multiple witnesses. police are in the process of trying to get as much information as possible. we can see an overview of the situation. the police and fire department have a three to four block area cordoned off. these streets will cause diverses for the next four hours -- diversion for the next four hours will they are able to

>>> good morning i'm eric thomas, in for cheryl jennings. >>> and i'm kristen sze. katie marzullo is live at santa clara county court in san jose. will the trial continue? >> reporter: it will. it was the defense late last week filed a motion for a mistrial claiming the d.a.'s office put the priest on the stand and allowed him to lie under oath. the defendant will lynch and his attorneys were immediately encircled by supporters, activists, friends and family seeking justice for priest molestation victims. will lunch says father jerry lindner sexually assaulted him in the 70s. in 2010 lynch tracked him down and beat him. the d.a. office put father lindner on the stan last week telling jurors he would -- likely lie and deny the molestation the priest did that the defense asked for a mistrial calling the the d.a.'s office argued it was being honest and upfront with the court. the judge agreed. saying the defense could not prove with 100% certainty that father lindner lied because he was never charged nor convicted of molestation. >> if it is a mistrial we are relieved

good morning i'm cheryl jennings. kristen sze is off today. let's get to terry mcsweeney he's been following the dispute between kincade's girlfriend and estranged wife. >> reporter: the question has to do with a piece of . did kincade write on this piece of paper, a -- a partial will and hand it to his live-in girlfriend? that's the question. that girlfriend was in court this morning. take a look at her this is amy pinto walsh. the woman who lived with thomas kincade for a year plus until his death a couple months ago in april. kincade known for his wildly popular paintings died of alcohol and valium poisoning. she says he left her a piece of paper handwritten that reportedly says she should get 10 million dollars, plus the mansion. kincade's estranged wife says pinto walsh is a gold-digger and the case should not be in open court in any case rather in arbitration to keep it private and protect kincade's recommendations on his reputation. pinto's attorney says otherwise. >> we need to let the judge make his decision that's the only fair thing

. >> good evening, i'm cheryl jenning autos i'm carolyn johnson.aw enforcement sweep targeted prostitution. >> and fbi and bay area authorities rescued several children. abc 7 news joins us live with the story. vic? >> there is a sweep lasting three days, 0 agencies participated. the sweep covered five cities and is code named operation cross country. it began last wednesday. it ended three days later. >> this is 57 city as cross the country. and 79 children and and many of the arrests were here in the bay area, police say they included 61 adult prostitutes, three johns and seven pimps and rescued six under aged prostitutes. among the highest number taken into custody in the sweep. >> every city has one or two juveniles liberated. none had mer than six. >> most of the local arrests made in oakland as were most of the rescues. >> during this operation, we arrested 31 adults for prostitution and rescue for juvenile as way from prostitution. >> it april yoors to be the same story. during our ride along was police, we've seen this over and over again.
