joining us now, nbc's chloe melas. chloe what do we know about this plea deal today? looks like he's struck some sort of a plea deal. we know he's going to be pleading guilty to some sort of lesser charge, but we don't know exactly what that entails. i did speak to lawyer misty maris moments ago who said it is likely that his driver's license will be suspended for up to a year and that this really isn't celebrity treatment, that he has struck some sort of a plea deal with prosecutors, because he is a first time offender. now, remember, the police report at the time of his arrest on june 18th, the officer said that justin timberlake had told him he only had one martini. up to this point, justin timberlake's attorney edward berk jr., he has maintained that law enforcement made errors and he actually was admonished by the judge earlier this summer, i was in the courtroom when that happened, when the judge said that he needed to raise the bar, not lower it. and that's when he suspended justin timberlake's license for the duration of this case. but it will be interesting t

joining me in studio, nbc's chloe melas, along with legal correspondent, lisa rubin.rt of the retrial or tell us what's going on? >> let's start with are they part of the retrial. i think that issue has not yet been decided. the assistant district attorney in charge of the case said she's prepared to have the new charges be a part of the november 12th trial date for harvey weinstein. you heard some real push back from harvey weinstein's lawyer saying if these are new charges, they should be dealt with in the ordinary course. he deserves the opportunity to have discovery and the full free trial process you would have for any new charges. as to the new charges, we know they involve three incidents from 2005, 2006 and much later in 2015 or '16. what we don't know is who they involve, much less if they involve three women or one woman. >> so harvey weinstein was not in court. he had emergency heart surgery, was it earlier this week, last week, i don't remember exactly. i think it was earlier this week. his lawyers have brought up his health. what can you tell us about tha
