chris? >> reporter: well, i've come here from the courtroom. this all happened within the past half hour. the judge summoned the jury back in. the lawyers were present. judge barry williams said, you've given me a note indicating that you are deadlocked, you must try to reach a verdict, it's your duty to try to reach a unanimous verdict, you must consider the judgment of all of you, you must consult with each other, do not hesitate to reexamine your own views and discuss them. now, judge barry williams has used what they call the exploding charge, trying to break a log jam. there is no indication how the seven women and five men of this jury are divided. there are four different charges. manslaughter, assault, misconduct, and reckless endangerment, and they appear to have reached a unanimous verdict on none of those charges. now, it depends, if it is close, if it's 11-1 or 10-2, perhaps this exploding charge will break the log jam, but if it's 6-6, there doesn't seem to be much chance. the judge sent the jury back in to deliberations. no word right now how long they will be allowed to or

chris, we had a tornado threat in our part of the carolinas as well tonight. chris: we sure did. we did a tornado cut in from 7:15 until 8:00 tonight, taking you through the storm. it started in lake lure and moved over i-40. this, likely not a tornado, but it had signs of rotation. strong rotation here. if it touched down it was in rural areas. the national weather service will let residents take assessments of what their arere like. makes creek road, timber road, that community seeing the strongest rotation. it had very tight rotation. the red was wind going away from the radar, the green being the wind coming towards the camera. you can see the rotation. that is likely where the tornado was, if it did touchdown. looking at it from a side view, you can see the tight rotation they're just west of marion, north carolina. here is the confirmed tornado we know about. there is charlotte, there is monroe. south of monroe, right here along highway 207, a confirmed tornado. tonight, the tornado threat is lower. it is not zero. the biggest threat is flooding. torrential, pouring rain. h
