"today in the bay's" christie smith live in san francisco with the latest. orning, christie. >> good morning, john. it got kind of tense out here overnight as san francisco police moved in, they pulled out a loud speaker and gave occupiers a five-minute warning they would have to go. some of them did. right now it's pretty much down to the cleanup. the encampment was dismantled and for hours now public works crews have been power washing justin herman plaza. fran police moved in about 1:00. the police chief tells us about half the camp agreed to move out on their own. new numbers, 70 people arrested. there was a group that actually separated out onto market street and two people were arrested there for throwing chairs at police officers. one woman who tells us she's been camping here at the plaza for about a month, says she had trouble leaving and got arrested. >> i walked this way and there was a wall of police in riot gear. i said can i walk out and they said no. i stood there all my stuff. and there were other people saying they won't let us lead. they wer

christie smith joins us live with more on the story. good morning, christie. >> reporter: good morning, la a laura. the governor came up with a plan to house more juvenile offenders in state facilities. this could cost about $6.2 million. probation officials here in alameda county have come up with their own idea to basically house them locally and then ask the state to chip in. this according to the oakland tribune. the started as part of the trigger cuts that tie into a trend of shifting responsibility from the offenders for the state to counties. right now alameda county pays the state about $500 a year for each juvenile offender, and this is to feed, clothe, educate and supervise the most serious until they're 25 years noeld brown wants $125,000. state figure show the cost is closer to $200,000 each. they are skl the state to cough up $150,000 instead to them. to keep the offenders here locally. the county is already building a new camp, 140-bed facility. it's not a done deal, though. a judge would have to okay it before it goes thro

i'm christie smith. back to you. >> 6:02. the chp says the annual holiday dui crackdown is already yielding results, and it's not over yet. extra patrols will be out to keep an kwi on partyiers. police have arrested more than 1,000 people in the bay area. almost 500 of them were arrested in alameda county. dui checkpoints will be set up throughout the bay area tonight and tomorrow. >>> the state supreme court says yes, in fact, it is okay for the government to take away local redevelopment money that could take away money from the 49ers stadium project. they committed $40 million to the new stadium. no one is sure if the money will make it to the project. but one council member is not too worried. >> i believe it will move ahead because the funds were committed prior to this legislation. >> gilmore says the city cannot provide the cash the 49ers are on the hook for it. they are urging city leaders to put pressure on lawmakers. the redevelopment ruling may mean an end to the ballpark. they wanted to build a new stadium to keep

christie smith sf live in oakland to run down a few laws. now there's a new crop of laws, hundreds of them coming up this new year's. we'll give you a brief rundown starting if you have a child o who rides in the car. they need to remain in a booster seat. the old law said they would stay there until they were 6 years old. i'm going to have to break that news to my 7-year-old. shoppers won't be able to buy alcohol at those self service check-out registers. they'll go to the regular checkout just like everyone else. people under 18 won't be allowed to use tanning beds. doctors can still allow it. and for soup lovers, they'll ban the importation of shark fins. for those already here, they can be sold until the year 2013. also schools have to remove student athletes for sports if they appear to have a concussion or injury. they can only return with medical written consent. minors won't be allowed to buy cough meds that contain any ingredient that is taken in large doses could make them hallucinate. a lot of young people using that to get high.

i'm christie smith. e. >> thank you very much, christi. >> former giants slugger barry bonds will get his sentence for obstruction of justice tomorrow. bonds is set to be sentenced in a san francisco courtroom. prosecutors say bonds should serve 15 months in prison. but his defense team is asking for probation. bonds is accused of misleading the grand jury during his testimony about steroids. the jury convicted bonds of obstruction of justice earlier this year. the men are accused of punching snow and kicking him when he was down outside the season opener in march. he was showing improvement, talking with loved ones and writing his name. >>> and oakland police officer caught on video firing a nonlethal weapon is reassigned this morning. this video here shows scott campbell's point of view as he walks several yards. you can see an officer whose name has not been released firing a nonlethal shot. campbell is suing the oakland police department in federal court. it found other industries are lagging behind w

loren is here in studio with a look at how long this is all going to last, but we begin with christie smith, live in oakland, where wind gusts toppled a tree right on to a home. good morning, christie. >> reporter: good morning, mar lachlt i'm not feeling any wind at all here in oakland hills. the damage is done. this is a cypress tree. the family was sleeping when they heard what sounded like an earthquake, they're telling us, and the tree crashed right on the roof. fortunately, everyone got out okay, including two small children who were in the very front room here. they were sleeping and slept right through. the owner says it was the night before last. he had only just moved into the home about four months ago. he says his insurance will take care of it and it should be repaired in a matter of months, hopefully. they say they heard a big crack just before the crash. i also caught up with a homeowner on skyline boulevard this morning whery huge tree branch crashed down on his deck, sending a railing flying down 30 feet to the ground. he met with his insurance add adjuster today and says a

christie smith is live in berkeley with an update on the fire. good morning, christi. >> good morning, marla. we're starting to see neighbors walking around trying to see the damage for themselves. it's pretty bad. this home here and the one behind it tucked away in trees. investigators will be here in an hour or so. one man saw sparks in the trees and looked closer and saw it was his neighbor's house that was on fire around 8:30 last night. to make matters worse, a power line came down and crashed over a fire truck. and there was really nervous neighbors who hosed down their own home. this is in an area with a lot of trees and bushes. some of the neighbors evacuated. no residents were hurt. four firefighters are recovering. two suffered from smoke inhalation. the two others had minor sprains. i'm christie smith. jon and marla, back to you. >> we're glad everyone is okay. people on the pacific island of samoa will go to bed on thursday and wake up tomorrow on saturday. the government decided they want to be west of the international date line for

i'm christie smith. back to you in san jose. >> in the meantime a san francisco community is keeping a closer watch over itself neighborhood after several women were attacked there. two rapes over a three-week period along 24th street and the mission district. police believe the rapist is still in the area. here's a sketch of the man investigators say attacked two women. police also released a video of the person they believe is the suspect. investigators hope someone will recognize him before he strikes again. 5:04 this morning. a man is recovering after being beaten by a bat or a stick near a popular hang out. the attacker is still on the loose after beating down his victim on university avenue. this happened early wednesday morning. the victim was out drinking in bars downtown. but so far a motive for the beating is unclear. it's not the first time an alcohol attack happened in the area. >>> one of the suspects involved in a brutal attack will be in court today. she was in her boyfriend's car, alleged

christie smith joins us live in concord with more. good morning, christie. >> reporter: good morning, laura. this park is surrounded by homes and families use it. they bring their kids here. someone is shooting ducks and geese and leaving them for neighbors to find. that was the case this weekend. and i have to tell you, you know, the video is unpleasant. it's disturbing. it tells you what's really happening here. this e weekend the visitors found four geese dead. a fifth one was limping, apparently hit in the leg. the animal control couldn't retrieve it. but they think someone gave in with a pellet gun or bb gun and shot them a few days ago. a neighbor said he saw three other ducks or geese floating in the water. within recent weeks similar incidents were at willow pass park. >> the way the birds were killed, the way they were found, areas where they were found, there's a good possibility it was connected. but we don't know for sure until we finish the investigation. >> and neighbors are really upset by this, telling us they want the

one of the programs that will see a lot of change will affect california's youth offenders christie smith is live in oakland with more on the story. good morning, christi. >> good morning to you. caring for the youth offenders is expensive. about $200,000 each according to state figures. that is to supervise them, house them, educate them, feed and clothe them until they're at least 25 years old. governor jerry brown is now proposing a major shift that might put more of the burden on counties to pay for them in state lockups. this according to the oakland tribune. right now alameda county pays $500 million a year for each of them. brown wants at least $125,000, which would be about $6 million a year for alameda county. these possible trigger cuts were announced tuesday and follow a trend of responsibility shifting from the offenders. the chief here has a different plan. he's talking about putting them under local supervision and asking the state to give money to this the county to help to them to the tune of $150,000 each. now they're building a new camp to house serious and nonserious yo

christie smith is live with more on where you'll be seeing protests today. ood morning, christi. >> good morning to you. one of the protests will happen here on the county courthouse steps. i've been speaking with a group involved with this. they say they chose this location because this is where foreclosure auctions take place midday. they say they want to draw attention to it and try to help homeowners struggling to keep their homes and get a loan modification. it's a collection of difbt community groups coming together on this day of action. they'll work with homeowners and how one family plans to reoccupy their home. they say it's about trying to get the attention to where the homeowner had little success on their own. and it's coming together with the occupy wall street movement. >> we are helping people go to the bank. we've gotten load modifications and principle reductions so that people could afford their modified loan. they have events planned all day beginning at 10:00 this morning with homeowners sharing the specific stories. they're also going to
