the city costs estimated included poor facility investigations and costs for other city departments, marsha the police department and the mta. this resulted in a total 77.3 million in costs, new costs, and offset by the estimated revenues, primarily sales tax and hotel tax related to hosting the events for a net cost of 57.8 million. we also reviewed the long-term development rights entities have been discussed some what already today so i will quickly say how we approach this. we looked at 3 which would have been transferred to the event authority under the original agreement and they are listed here. the term was that no rent would be paid to the ports. incremental property taxes would be used to reimburse the event authority for an least a portion of the $150 million required expenditures. recent the highest and best uses of the three properties as identified by the real estate consultants. these were the uses as assumed. pier 32 had a mixed use and this would occur after 10 years of releasing the facility's construction for the event which would be on a shorter-term basis. on pie

city. i have had the privilege of working side-by-side with ed of those years in different roles. when you go through the process of making changes and when you win an election, you should make changes. there is always someone who is top of the list. it is amazing because he is always at the top of the list for multiple roles. when you think about the fact that we have an opening here, wouldn't that be perfect? we could not really figure out the last round when i won reelection what the appropriate next step would be and the next roll was what he was assigned to and that is the role of actually managing those departments. people forget how powerful howell -- how powerful the city administrator is. when you were mayor, it is critical to have a friend as the city administrator. i think that he should exercise his full power. i am reminding him of the charter. and he has been a friend over the years. he is someone that i respect. it is an amazing thing to reach out across the political divide.

i am wondering if the city attorney's office has any comments on that. >> deputy city attorney. the agreement contemplates that if there are disputes they would first be resolved or attempted to be resolved through mediation. if that was unsuccessful, they would be referred to the icc for binding arbitration. section 18.1 -- i am sorry. supervisor campos: 18.3? >> correct. any dispute or difference that cannot be amicably settled will be finally adjudicated by arbitration under the icc. that choice as a forum was one that was negotiated and requested by the team. their rationale was that they wanted what they characterized as a neutral forum, because it is an international sporting event, for adjudication of disputes. and they were afraid that having all disputes resolved by jams would confer upon the city what they called a home field advantage. the decision was made as a negotiating position to cecde to that request, and the icc was chosen as the forum through which arbitrations would be conducted. supervisor campos: where are they had quarterbacks -- headquartered? >> i think

the issue from the time the city gave mr. jacobson notice was about whether or not on the city side or on the property owner's side. i think that is clear. >> after mr. jacobsen -- we clearly it acknowledged there was a problem. you could see the sewage coming out of the trap. the question is why was it coming out? was a problem with the jacobsen's property or city property? when the jacobsen were notified about the problem, he had a plumber come out and he said that the problem was out in the city lines. there was discussion between jacobson and the city about that. the city said we decided it is on your property. there was a notice of violation that said there was a problem with the house trap, but did not specify the problem. how is it effective? it is my understanding that typically if there is a problem with the house trap, sewage will back up into the house, as opposed to the street. that said, the bottom line here, after all these years, the work has been completed, it has been finalized, it is code compliant, and the

the host city agreement provides that over the course of the next year, the city will take the lead on performing compliance with the california environmental quality act for purposes of studying the event and any environmental impact that might arise. there will be a lot of consultation of state and federal permitting agencies. at the end of that year, that document is appealable for the board of supervisors. the options will include hosting the event in san and cisco, hosting the event at some alternative location, those have been described as a no project alternative that would allow the city to not proceed. the second section provides a number of plans will be developed. subject to review by the authority. at the end of that period, both the authority and sfacoc would have right to terminate the agreement without harm. i will defer to jennifer to discuss sections 3 and 4 of the agreement related to securing the course area, getting approvals to run the rates on san francisco bay and secure aerospace. and we would enter of a new leases for all of the locations that we have talked ab

that is why we project so much sales tax for the city. for piers 30 and 32, we were conservative in what we imagined. we did not want to imagine any uses that were currently -- we are not reporting to sort of put forward a plan for those peers. we just need a reasonable numbers to say what might in project look like? what could we imagine those tax revenues being associated with? i think rather than saying would be the best thing for the city, it would be other considerations. obviously. >> you don't remember the numbers being conservative? gosh especially on 26 and 28. >> i left out one important point that and want to refer you to. i've already told you an hour prior report on the long term development rights, we are reporting there would be a net gain as opposed to a net loss for the city. with respect to the direct cost of the city's treasury, if you take a look on page 3-2, we are stating it will cost the treasury of $11.9 million whereas previously we reported it would cost the city $57.8 million. that is a significant improvement o

chemicals on city property.you are examples of creativity come up with by city staff as ways to greatly reduce pesticides. everything from the framers used in golden gate park to the compost on golf courses and airports. the list goes on and on. all of those are the results of city staff wishing, in their way, to make a statement that they do not believe those are necessary in a good deal of city property. in the last 14 years we have managed to reduce pesticide use. we do not use pesticides on city playgrounds. every step person in the city thinks about them as a last resort. the department of the environment is not the one doing this work. it is our city partners, agencies, and notably here today we have record park areas here to look at these amendments in support of them today. so, what these amendments will do is strengthen the ordinance and bring it up to date. we really want to thank the mayor and the supervisor who are not here today for coming to us and saying -- great job, but how can we make it better

with the city attorney's office. we feel we have done that. i would like to spend just two minutes going over some of the proposed revisions to the agreement that we think makes it stronger. first in section 6.2 of the agreement, now permits the authorities investment in some of our historic peers in the northern waterfront with rent credits to repay that investment. section 7.3, consistent with the budget analyst recommendation provides for a term sheet approval of any long- term development rights by the board of supervisors. we have entered the budget analyst's recommendations regarding fair market rents by an appraisal process. the board negotiated for participation read, which is something that we have been trying to get out of this agreement for some time. basically, some terms of balance the fundamental give/get that the authority invested in a waterfront, and they get long- term development rights to be paid back. we have provided a memo to each of your offices summarizing each of those terms. we have submitt

official notices for all city departments. individual departments will also be required to have a prominent official notices link on their respective home page. this also directs the clerk of the board to work with the clerk of technology and librarian to implement these policies. what this does not do is mix changes to requirements under the brown act or sunshine act, makes no changes in newspaper publishing specifically required by state, federal, or local law. in closing, the public needs to hunt each department's separate web site to find their notices, if there are even notices to begin with. publishing with newspapers have become an archaic and expensive process, and we should reevaluate where is not legally required. this ordinance will make the city's library one of the centralized repository for information, and both the department of technology and library are confident they can provide the service. there are a few amendments and i would like to submit. one is on page two, line 17. we would insert after section 2.98,

the host city agreement has three principles. we needed world-class facilities in a world-class city for this international event. we needed to secure state and federal for the port for the on the water activities as well as the air activities, and we needed to bring corporate sponsorship to this event because it was obviously untenable to have the city's general fund facing the deficit that we are there these burdens. we have endeavored with the board of supervisors endorsement of the term sheet for a vote back in october to move forward on those principles, and as we have been in negotiations with the team, which are ongoing, i should add, and i think you will hear more from your team today, how we very much remain in conversations with them and are trying to improve upon that which is before you today, we have created the america's cup organizing committee and an honorary committee that includes the mothers and fathers of san francisco who stand behind a commitment to raise the money necessary to make sure that the city's cost

this is really a great city. the world series just made me realize how truly the whole city loves this city, and to have this come or not, -- to have it not, after the world series is not even something i want to think is possible. i encourage you guys to do what you have to do to bring this to san francisco because it will improve my business. it will improve other businesses around san francisco bay, and as other people mentioned, it is a difficult economy out there, even for something as simple as business.
