now the long time county executive who is at the end of his term as the county's top leader is at the beginning of a battle to stay out of jail. a clearly shaken jack johnson walked out of federal court flanked by his two lawyers proclaiming he is innocent of any wrongdoing. >> to all the citizens of prince george's county that i'velong and i've served you well and most of you know me well. i cannot go into these allegations because my lawyers will kill me if i do, but let me say that i'm innocent of these charges and i just can't wait for the facts to come out and when they come out, i am absolutely convinced that i'm going to be -- we will be vindicated. >> reporter: federal agents had 13 search warrants on various sites and the johnson home today before arresting jack johnson and his wife newly elected council member leslie johnson, but the investigation started in 2006 with allegations of the county exec receiving payoffs for favors from developers. according to court documents, investigators say they tapped his phone from september, 2009 to now and based on what they heard, it co

prince george's counties' chief law enforcement officer. his wife leslie has just been elected to a four-year term as a county council member but now we learn the fbi has been investigating shakedowns by johnson at least since the start of his second term. sources say the latest allegations revolve around a massive development near the green belt metro station. going back two years investigators have been looking at shakedowns of developers interested in green belt station. this year, a new carollton developer sued prince george's county alleging johnson and his allies. despite the allegations of checks down the toilet and money stuffed underwear his spokesman insists that johnson has been a good leader for the county. >> he brought a lot of development and a lot of jobs to this county. and brought a lot of pride here. jack johnson is, if not the greatest, but one of the greatest county executives and local politicians there are in the washington region. and his record speaks for that. >> reporter: again, you heard at the news conference fr

he will be allowed to report to duty as county exec you havthe here in prince george's county. he'll remain county executive as far as we know for the next month. he'll be allowed to leave this home for work, also for doctor's appointments and to confer with his attorney. other than tat he must remain in his mitchellville home. there will be some sort of electronic monitoring. and mrs. johnson was allow the leave on her persona recognizance. she will not be on any sort of home de10:00 but they were also told tosurrender their passports. they were both indicating they wanted to waive their 30-day preliminary hearing rights and they set up a preliminary hearing for december 13th in this case. that's when they're due back in court for basically for the prosecutor to outline the case. what charges they have against them. in order to continue to be prosecuted in this case. it is still possible that indictments could come do before tha would happen. some documents have been released, indicating there were a lot of transactions dealing with real estate developments and today there was

the prince george's county executive taken from his home. wjz is live in prince george's county. alex demetrick has more on the evidence uncovered in jack johnson's home. >> executive jack johnson and his wife leslie are due to be released from custody later this evening, after both entered not guilty pleas to violating federal law. each are charged with witness tampering and destruction of evidence in a federal investigation. they were arrested about 10:00 this morning, at their home, when the fbi feared they were in the process of destroying evidence. now, along with the charges, the court also unsealed a 10- page affidavit, detailing the johnsons' alleged actions. and joining me is my colleague, kelly mcpherson who has more. >> reporter: they have been watching it since january. but all of the crimes they're charged with happened just this morning. it started when the fbi interrupted a meeting between a developer and the county executive. and right after, his wife, leslie johnson, made a phone call saying that the fbi was at their house. we have a phone call the fbi documented

most of the funding agencies for us is almost 100% from the county. while the prosecution has the benefit of grants. in fact, i believe the district attorney might have at least half of their budget is provided by grants. that is not provided to the indigent defense providers. federal grants are almost all directed toward prosecution and law enforcement. so the problem to have vast resources that i'm facing right now is that you have grant funding the police department, the sheriff's deft, the district attorney's office. there is a share that -- etc., etc. that share, which for them is a portion of their funding is almost my entire funding so when you say you're going to cut 13% off everybody equally. well, 13% for us is more than 13% of their entire budget than for the other agencies. now the problem is that's the ripple effect we just had here. now they still have their investigators because they have other agencies that provide the investigation. we don't. our investigators are the ones that have to be trimmed off because we can't pay for them. our
