he shot and killed 39-year-old jean smith and her son james inside their home in dale city last decemberr: 18-year-old xifier pinkney sat stone-faced as the judge pronounced the verdict, guilty on two counts of capital murder for the victim's husband and father the decision brings some relief in the wake of incredible loss. >> this has been very difficult, nine and a half months, obviouslyaving this moment weighing over us for all that time it's made it that much more difficult, and just very relieved, very pleased that the justice system worked for us. >> reporter: the bodies of 19-year-old james smith and his 39-year-old mother jean were discovered just six days before christmas last year in their dale city home. a younger sibling connor made the tragic discovery when he arrid home from school that day. testimony today revealed for the first time exactly how the two were killed. james, a jmu student home from college, was napping on the couch. he was shot between the eyes. >> and, of course, the mom came home and she was naturally upset. she ran up to try to use the phone to call 911,

we learned a little bit more about what happened on december 19 in dale city.he suspect had already signed a confession. some details were not discussed. he found an unloaded gun in the smith family home. he then, and loaded the gun and shot a 19-road jane smith. according to the -- james smith. -- 19 months old james smith. the suspect then in his own confession admitted that he left the premises, realized he forgot his jacket, came back, and that is when jean smith, james's mother, found her son's body. she was in the process of being on the phone calling for help when she was shot through the year. aording to his confession, pekingese says, and this was key to getting him capital murder, he was thinking, how my way to get out of this? he knew she recognized him and he reacted and shot her. >> the judge does not believe it was a reaction, but premeditated murder. after the guilty verdict, her husband and father of james smith, rick smith spoke to us. >> this was obviously a tremendous step for us so that we could get some kind of justice for jean and jim. >>
