damian trujillo is at the sheriff's office where the incumbent is fighting a serious challenge. damian? >> raj, deputy sheriffs association endorsed kevin jenson for sheriff. today a political move by the deputies. they overwhelmingly gave the sheriff a vote of no confidence. the polls won't open until tomorrow morning. machines have spent the last week counting votes. >> we're in full swing of opening all of the vote by now ballots that have come in. as of yesterday, 114,000 that have been returned. >> one of the races in the bay area is the race for santa clara county share rich. deputy sheriffs association says its members have cast their vote. a vote of no confidence against four term incumbent, laurie smith. >> a way of showing the lack of satisfaction with the performance of the current sheriff. >> laurie smith's opponent is within of the former captains. smith deferred comment on the vote of no confidence to the consultant who told me the deputy sheriff's vote its a voting process that scud make vladamir putin proud. we don't take it seriously. the sheriff declined our req

damian trujillo broke the story. >> reporter: the chief's office tells me he needs to meet the minimum standard staffing levels in order to keep his officers safe on the street. so mandatory overtime looms for his rank and file. these officers captured two people today after a foot chase with the suspected burglars. beginning this weekend, those same officers may be forced to work part of the next shift as well if the need arises. >> we have certain mandatory minimum staffing levels in the department that we need to adhere to. >> reporter: san jose's assistant police chief says there have been days when the number of on-duty officers can't meet those minimum staffing levels. not anymore with the mandatory overtime. >> we'll take volunteers first, obviously. and reversing seniority that we're still working out, we'll hold over that amount of officers that we need to ensure that we have the minimum staffing levels in patrol. >> overworked and fatigued officers will not improve safety in our neighborhoods. >> reporter: the police union points to this 2-year-old report by the city auditor.

damian trujillo is here with this story. officers were just having lunch. >> we are waiting for las vegas police to identify the shooters in this case. we are getting reports the suspects may have belonged to a white supremacist group. this started before noon at a las vegas pizza place yesterday when two officers were having lunch when the suspects, a man and a woman, approached them and shot them at point-blank range. one of the suspects was hurt saying, quote, this is a revolution. people are opening fire. the duo then took the officers' guns and ammunition and ran to a nearby walmart store where they allegedly killed an innocent bystander just inside the front door. when officers arrived, a gunfight before they say the couple completed an apparent suicide pact. >> a tragic day. it's a very, very difficult day. but we still have a community to police and we still have a community to protect. >> nbc's jay gray joins us live now from outside that walmart store in las vegas. jay, still a lot of unanswered questions, but we e

damian trujillo has more on what's the protocol. >> reporter: mountain view says they can only speak for its department. on this case, on this street, the police officer did everything right. the lieutenant pulled over in his personal car to let a tailgated driver pass him. that driver almost hit two bicycles at a crosswalk. when the officer saw the car pull into his own driveway, the officer approached him to have a conversation about safety. the officer drew his sidearm when the driver charged him. >> because of the violation, the fact that the mom and child were almost hit and driving into an opposing lane of traffic. it's all very dangerous. he figured he'd have a quick conversation with the neighbor. >> reporter: mountain view says a cop is a cop 24/7. but each incident is treated on a case-by-case instance. if the cop is at a bar and the situation arises mountain view says depending on that situation it might be best for the officer to act as a witness instead of getting directly involved. and according to that police report, the driver in this incident here in san jose admitte

damian trujillo joins us from san jose state where a lot of students have benefitted from his programter: they have. this is a rags to riches story, a story about a poor man with a small wallet but a big heart. he began gardening after arriving in this country 50 years ago. >> i had $6 in my pocket. i didn't know anyone here in redwood city. >> reporter: he now employs four other gardeners for his landscaping business, a job he still does with pride. >> we come here looking for a better life. and it's not easy. it was very hard to start. i thank god, after 50 years i'm here. >> reporter: not only is he here, he is drawing lots of attention. he's the recipient of the jefferson award, a national recognition given for public service, and this man is one of the reasons. he was about to receive a $1500 check from the bay area gardener's association established by his boss. >> he wants to make a difference. we have to be there fighting for our dreams. >> reporter: in the last eight years, the foundation has award awarded almost $25,000. >> i can see the need that they have. and i can tell y
