dan springer is joining us while watching the vote count. this a change in miller's camp a sign that they are planning to give up? >> reporter: well, it appears that way, uma. let me just tell you that joe miller has not made his way to the vote counting center, and there's no sign whatsoever that he is going to succeed until every last vote is counted and his challenge is heard in court. we saw yesterday a subtle change in his observers. the body language started to change a bit. we started to notice there were fewer challenges to votes where lisa murkowski's name was spelled correctly. those folks had been getting he's in the local press and quite frankly on fox and other networks for challenging votes that were obviously valid votes where there wer there was poor p or because the voters put republican after her name. as those type of challenges decline, murkowski's percent of unchallenged votes ends up to 91%. if that trend continues, she could win despite the court case over misspelled names and voter intent. yesterday she spoke about ho

dan springer is live in you. >> -- in juneau, alaska, tonight. >> reporter: this is the first day ofounting the votes in juneau, and the trend continues to look good for senator murkowski and if there is one surprise to all of this, it is how well all of her supporters can spell a not so easy to tell name and she might have enough unchallenged votes when the counts wraps up next wednesday to beat joe miller without a court fight over voter intent and miller and his lawyers maintain the murkowski name has to be spelled perfectly to counted and earlier today he made a surprise visit to the counting center and wanted to thank the volunteers and encourage them to keep the challenges coming and the observers have taken criticism from team murkowski for challenging correctly spelled votes over things like penmanship and come mass or the word, republican, after her name. >> i think what needs to be applied is the stat statute and that statute makes it very clear as to what is required. and, frankly, our position is, that will be determined, i believe by a court ultimately, assuming the vote

dan springer with the news from juneau, alaska. joe miller is an attorney.t is he saying about the filing of the case in the wrong place. >> well, of course, he is defending that he filed this suit in federal court and that that is the right place for it he says this is a federal matter. but, of course, you are hearing that the attorney general in the state of alaska says this is a state matter. this is a challenge to how the state elections division is handling the state election law, which says that the writing on the ballot, the write-in name has to appear as it does in the candidacy fill-out form. and so you have this debate over which venue is the right place. but it's going to proceed in federal court, at least until the judge decides whether the venue should be moved over to state court. jon? >> jon: so as more ballots are counted, are we seeing anything different? >> yeah, today we saw something interesting. later in the day we saw that the percentage of challenges to ballots that were filled out with lisa murkowski's name spelled correctly actually

dan springer tracking this story from our pacific northwest bureau tonight.is miller saying about conceding here? >> well, he issued a statement today an conceding was nowhere in that statement. so it appears he is going to continue the fight to at least for a few more days. we went to his web site. it says it's a cliff hanger. they are not going to give up. they are still raising money. the election division has it as a 10,000 vote murkowski lead with 700 left to count. even if you throw all 8,000 of those challenge ballots for misspellings of murkowski's name, that's still a 2,000 vote advantage for murkowski. she flew to anchorage and will declare victory in a couple of hours. miller appears no closer to conceding. sounds like he he wants to continue with his court case even as she is certified the winner this month. >> not a question win lose or draw. consistency affly division of elections in the future. >> that was on neil cavuto's show earlier today. miller says he will make his decision on friday, shep. >> shepard: senator murkowski didn't have the su

dan springer's live in the alaska so, dan, how are those challenges being handled as they go through these ballots very, very carefully, in fact, they're just wheeling in the new ballots to be counted, so i'll get out of the way and show you as they walk in the new batch of ballots. 20% of the votes were counted, and nine out of ten murkowski supporters know how to spell her name. they did not get challenged. 8% were challenged by miller observers because of minor spelling errors, maybe hard-to-read writing, but the elections directer counted those for murkowski because, she said, she could phonetically pronounce the name. they're segregated because of the legal challenge. lieutenant governor craig campbell said yesterday why close counts. >> the intent of those counters and division of elections is to make sure that the voters are not disenfranchised, that if there really is an intent to vote for whoever, that that gets counted. >> reporter: and campbell cited several court cases which, basically, dictates to elections that they have to take voter intent into consideration. jenna? j

dan springer with the news live for us in juneau, alaska. ng to witness these challenges. how does it seem? >> well it seems to me and a lot of observers here that almost everyone who voted in this election for a write-in candidate meant their vote for lisa murkowski. there is a few notable exceptions. did i see one today for mickey mouse and one was for donald duck yesterday. but almost all of the votes being challenged for joe miller spelled correctly or off a letter or two. the question for the courts will be do they follow the strictest interpretation of state law or existing case law? >> i think the alaska supreme court has been abundantly clear expression of the intent of the voter. that's because you want to count as many votes as possible hasn't had to to do with how write-in candidates appear on the ballot. the law hasn't been decided in this area. it hasn't been decided in favor of voter intent. >> shep, you may remember that first gentleman ben ginsburg he, of course, was the lead attorney for then candidate george bush in tallahas

dan springer has been following count. what's the latest? >> juliet, this is like the energizer bunny, it keeps going and going. we are on day four of this count. this is what happens when the candidate called write in ends up winning the election because now we have to find out who write in actually is and we've got this battle over whether murkowski's name misspelled can actually count as a valid vote for her. a short time ago, joe miller made his first stop here at the counting center in juneau to rally the troops and tell them to challenge any ballot that does not have her name spelled perfectly. some of the challenges have been, well, let's say it was spelled correctly, but didn't look like that great handwriting or maybe a comma was between the names. we asked miller if that was an appropriate challenge if they're having a strategy to bump up the number of challenges that they had. here is what he said. >> there is no strategy in the sense that other than we want to make sure it's fair. and i made that very clear to my team and i think

dan springer has more live from skwrao*upb owe -- juneau, alaska, dan. >> reporter: we are seeing a uniqueook of democracy in action. an observer said what we are seeing here is not just a spelling contest, how to spell lisa murkowski, but a penmanship contest. one ballot was found out, because they couldn't tell if it was a spelled correctly. that ballot went into a challenge bin. this is where all the election workers are set up, two per table. they are also joined by two representatives, one from the miller campaign, and one from the lisa murkowski campaign. they are going through all 230,000 votes that were cast in this election, and they are putting them in different bins. bin number one is for someone who voted for a person other than a write-in candidate. the bins we care about are three and four, because three is the bin where a write-in candidate was deemed to be a vote for lisa murkowski and the name was spelled correctly. four right next to it is a lisa murkowski-counted vote in which the name was spelled incorrectly and someone from the miller campaign challenged it saying this
