>> kate rooney, nbc news and msnbc legal analyst danny cevallos is standing by.could be an imposing sentence if it is what is imposed. >> reporter: the statutory maximum is a gigantic number. you add up the maxs and run them consecutive. it's not the likely sentence. in a case like this under the federal sentencing guidelines, t the loss amount can send it into the stratosphere. he will be able to point to likely millions of dollars that would drive that recommended sentence way up there into the many decades. you might get a good percentage of the way there. ultimately sentencing guidelines, ever since the supreme court decision over a decade ago are just advisory, so the judge can go below the recommended sentence, but make no mistake about it, it is the loss amount if bankman-fried is convict that had will really hurt him when it comes to sentencing. >> for now, danny, thanks. we appreciate your time today. >>> coming up, we're kicking off the drive to five with the ten-year yield only about 20 basis points below that level. up next, we'll look at the fallout

also joining us, assistant manhattan district attorney catherine christian and civil attorney danny cevallos. vaughn, tell us what we can expect to happen in court today in terms of the trial kicking off. >> we'll wait to see if any witnesses are brought forward. you see donald trump standing alongside alina habba, his legal spokeswoman. you see jason miller, his campaign senior advisor. just out of frame we saw his lead attorney on this case, chris kise who just met attorney general letitia james inside the courthouse. they briefly exchanged pleasantries and shook hands. leticia james was joined by other prosecutors in the office. we don't expect her to be the one presenting this case day to day. we don't expect donald trump to be here day to day. this trial can last into december, three months, if it should take that long. there's a long list of witnesses that will potentially come forward here. we're listening to donald trump. he's calling this is a witch hunt. this is a man who had the opportunity when he sat for a deposition with the attorney general's office to answer numerous question

also with me, of course, my friend and colleague danny cevallos criminal defense attorney, super lawyerbc legal analyst. tara, i want to start with you. thank you so much for being here. good morning. mike pence, out of nowhere, i don't really remember the name of the show. it was on a network. the big thing was, you are fired. and they go off, and they quit. and then one by one, the guys just dropped off the aisle. and now, mike pence is the latest victim. he did not necessarily get fired but he fired himself, he dropped out of the race. what are your thoughts on this? what do you think it means for the other primary candidates who remain in the republican field? >> was he ever really in the race? i mean, mike pence was persona non grata with maga from the very beginning, from the point where he decided to actually uphold the constitution as opposed to donald trump's bidding on january six, which is the one positive of the tenure of mike pence as vice president. i give him no credit for doing what he was supposed to do, really. but, so, he really never stood a chance. i used to joke al

danny cevallos is with us as well. in fact, his attorney, chris kise said there's no evidence to the contrary, asked the judge to reconsider. obviously the judge said this is bogus, what he tried to say. look, he was fined $5,000. he was told to stop it. now he has been fined $10,000, where does that leave donald trump. where does that lead the judge? >> sanctions follow a continuum. they start with an admonishment, then they go to monetary fines and at the end of the road is imprisonment. if the judge cannot get a person to comply with what the judge needs. judges have a lot of power. it's the inherent power of the court to control the docket and control the decorum of the courtroom, and sanctions can go all the way up to civil and criminal contempt, and that can result in incarceration. trump knows this, everybody knows this, and i think that trump, that the judge certainly had the discretion to decide that trump's explanation, oh, i was talking about cohen wasn't credible, and i think that was a reasonable conclusio

let's bring in nbc legal analyst and criminal defense attorney danny cevallos.imony be? >> he's given several previews of the information he can provide, to congress, in his book, in many interviews. we expect the state will use michael cohen mostly to introduce documents, to authenticate them, provide some narrative. of course michael cohen, the defense, the trump team, this is someone who is a convicted liar, you shouldn't believe him. if he's authenticating documents and the documents speak for themselves, that's going to be very effective testimony. essentially we already know he's going to argue -- excuse me -- give evidence that trump inflated artificially the value of his assets when he did things like apply for better insurance rates or other things that benefited trump. >> trying to get loansthat. >> loans, yes. >> let's talk about this gag order issue because trump apparently violated the gag order in that civil fraud trial, and now his lawyers are trying to freeze the gag order in the federal elections interference case. again, this is not a full gag
