. >> civil rights attorney and former prosecutor david henderson joins me now. officers entered a not guilty plea. we see the package from priscilla thompson, their lawyers believe there's more to see. but we have all seen the videos. what defense can these officers bring? >> you know, the only real defense here is to put the memphis police department on trial. i say that because you can say all you want to about we saw a snippet of the video, nothing undoes the snippets that we've seen so far. there is no good defense to these crimes. the only thing officers can do is either one, try to flip on each other, try to make it clear that they are being characterized as lone wolf's, but lone wolf storm roman packs. the problems that we see in these videos is a systemic throughout the police department, an american policing in general, they can try to point that out. the other thing that might be tricky to actually get to trial time is, the second degree murder charge isn't going to be easy to prove. but i trust the prosecutors -- cannon would indict these officers for

joining me now, priscilla thompson in memphis and mark morial and david henderson.priscilla, we will see the outpouring of love for tyre nichols this afternoon. bring us up to date on the latest information on this ongoing investigation. >> reporter: yeah, we saw the hearse pull in as this funeral prepares to get under way. even as this is happening, we are learning new information about this investigation. overnight, our affiliate confirming they received personnel files on the five officers fired and charges. four had previous disciplinary action in their file, including two of them who were both reprimanded for failing to file mandatory reports about use of force after an incident occurred. as we are learning about those officers, we are getting a look at that initial and unofficial copy police report. they said he was fighting them on the day this incident occurred. that he grabbed for one of their guns at one point. it also -- it mentions in terms of what the police did was they tased him, they pepper sprayed him and one officer hit him in the arm with a baton.

joining us now is trial lawyer, civil rights attorney, and cnbc contributor david henderson. had said in the wake of this terrible incident that the memphis police department has received far too much credit for its response because it's just cleaning up a mess that it created in the first place. explain what you mean. >> good morning, jonathan. to make a long story short the memphis police department recruited these officers, trained these officers, created this scorpion unit. recently we're finding out not only did it create the scorpion unit but with regard to these officers it received previous complaints of violence which indicated something like this might happen, still kept officers in the unit, failed to supervise them and so this result was ultimately inevitable. and if you want to question they want to be held accountable here even after all this information came out, they still maintain the position you know what, these officers don't necessarily reflect the totality of our department. it's a 30 to 40 member unit. these individuals make upwards of 20% of that unit.

let's bring in cnn political director david chalian, senior political analyst nia-malika henderson, andirs analyst, casey hunt. the president clearly sees going to florida and going after senator rick scott and what he said about social security and medicare as giving him a political advantage, at least in that home state of senator scott. >> in that home state and nationally, because when you defend, put yourself as the defender of extraordinarily popular public programs, that's a pretty good position to be in for politics. it's not just haphazard that this has long been called the third rail of american politics, and democrats and president biden think rick scott went and grabbed that rail about a year ago. they're not the only one, by the way. mitch mcconnell clearly thinks rick scott did as well, and that he's getting singed by it now. so, they're pressing this advantage. it is a politically advantageous place for biden to be because of how unbelievably popular these programs are. >> especially in florida where there's a huge elderly population that relies on social security and med
