joining me now, priscilla thompson in memphis and mark morial and david henderson.priscilla, we will see the outpouring of love for tyre nichols this afternoon. bring us up to date on the latest information on this ongoing investigation. >> reporter: yeah, we saw the hearse pull in as this funeral prepares to get under way. even as this is happening, we are learning new information about this investigation. overnight, our affiliate confirming they received personnel files on the five officers fired and charges. four had previous disciplinary action in their file, including two of them who were both reprimanded for failing to file mandatory reports about use of force after an incident occurred. as we are learning about those officers, we are getting a look at that initial and unofficial copy police report. they said he was fighting them on the day this incident occurred. that he grabbed for one of their guns at one point. it also -- it mentions in terms of what the police did was they tased him, they pepper sprayed him and one officer hit him in the arm with a baton.

joining us now is trial lawyer, civil rights attorney, and cnbc contributor david henderson. had said in the wake of this terrible incident that the memphis police department has received far too much credit for its response because it's just cleaning up a mess that it created in the first place. explain what you mean. >> good morning, jonathan. to make a long story short the memphis police department recruited these officers, trained these officers, created this scorpion unit. recently we're finding out not only did it create the scorpion unit but with regard to these officers it received previous complaints of violence which indicated something like this might happen, still kept officers in the unit, failed to supervise them and so this result was ultimately inevitable. and if you want to question they want to be held accountable here even after all this information came out, they still maintain the position you know what, these officers don't necessarily reflect the totality of our department. it's a 30 to 40 member unit. these individuals make upwards of 20% of that unit.
