and david louie was in court today. >> reporter: this is going to be an interesting and controversial case because people are wondering whether a star linebacker for the 49ers got special treatment or if he was treated like everybody else? he showed up knowing he could be facing over four years in prison, but in court his attorney argued before the judge that smith cooperated with police from the very first time they came in contact and that he continued to cooperate throughout the investigation into a party back in 2012 at a sapblg house where two people were shot and smith was stabbed at the party, and smith stood up and apologized to the court and said he would abide with whatever the sentence the judge issued. taking all of that into consideration, the judge sentenced smith to three years of probation, and 11 days in jail or 11 days of participation in a weekly work program. smith and his home and vehicles will be subject to search by any peace officer for four years and he must face several thousand dollars of court fees and assessmen assessments. >> i think aldon smith got treat

david louie has the story. >> reporter: 26-year-old alix tichelman appeared in a red jump suit and pink lipstick. she's a high priced prostitute linked to the death of forest hays found dead on his 50 foot boat named escape last december. the criminal complaint charges that tichelman injected hays with heroin and left to die. it was captured on video on board the yacht. >> in gathering her things, she was literally stepping over the body and at one point stepped over the body to grab a glass of wine and finish the glass of wine. >> reporter: tichelman is accused of removing evidence from the boat to cover her tracks. she and hays met on an inline dating site. hays was married and had five children. hays and his family lived in this large gated house overlooking santa cruz. neighbors were reluctant to say anything about the case or family. neighbors across the street say they never got to know their neighbors well but had parties, especially kids parties and would hear music coming over the fence. a public site reflects nothing but praise and respect. one person wrote it was clear his fa
