and so in one sense dick durbin is correct, that john roberts does have the power in his hands in dick roberts doesn't have clean hands on this issue either. we've read the reporting about jane roberts and her clients that haven't been disclosed. and this goes to the flaws of the ethics requirements. they don't require justices' spouses to disclose the clients. they only have to say the name of the company they work for. they don't have to say who hires them. so if ginni thomas's case she didn't have to say that leonard leo was funneling payments to her llc. and in jane roberts' case she didn't have to say law firms that appear before her husband all the time are hiring her. so i think that's going to prevent john roberts from getting on his high horse and policing clarence thomas's ethical woes here. so it really falls back on congressional democrats and dick durbin and richard blumenthal like you said to step up to the plate here. and so i hope that that hearing that dick durbin held last week, which was good, is not the final word here because it won't be enough. >> brian and i used

senator dick durbin wants to pass legislation around ethics requirements for supreme court justices. how likely is that? even if they do something, it's not going to be retroactive. anything we learned about clarence thomas, john roberts, neil gorsuch, they will be able to do, there are no rules currently. >> there are no rules currently. they said that they individually decided how to interpret the standards that they have tried to set in the past. you're right, congress, of course, would take this out. this is a partisan moment. there is some interest, at least, to hear from republicans in alaska, it is conceivable that the senate with bare democratic majorities, it seems very likely would pass the republican house. a lot of shouting about this issue, and i couldn't imagine that legislation will pass anytime soon. this issue is it will become partisan to have a consensus way to approach an issue that is, frankly, concerned about parties depending on which justices are there. it is just going to be part of the perpetual back and forth, us versus them, nature of washington politics t

and most notably absent chief justice john roberts who declined a request from committee chair dick durbin week. joining us now, nbc news capitol hill correspondent ali vitali. ali, what are we hearing from lawmakers this morning on the hill about supreme court ethics reform? >> reporter: yeah, ana, this is something we have seen bubbling in the last few weeks since the chairman of that committee, dick durbin, first sent a letter to chief justice roberts asking him to come in and testify because of those new allegations against sitting supreme court justices about undisclosed business dealingings that may run afoul of ethics concerns. they may run afoul of concerns but not actual rules. and that's the point of the committee hearing now, is to start the conversation on capitol hill about potential reforms to the supreme court's code of ethics. so far what we have heard and we're still in the opening phases of this, you see senator kennedy there on the republican side giving his opening statements, he's one of the ranking members on the subcommittee that is also sponsoring this hearing. they
