we've got problems up in dickerson and elsewhere. >> dickerson is our big story this morning. it was a fatal accident from overnight. it happened at 1:00 in the morning, single vehicle accident just west of 270 here in dickerson. in fact, i'm going to step out and show you a live picture. this was the only vehicle involved in the accident barely even looks like a car anymore. one person dead at the scene and the second one flown to baltimore shock trauma. if you are planning to head through this area, you'll want to know route 28 is closed between mount efron road. eastbound you'll be diverted at the mouth of monocassy road. a tow truck has arrived on the scene. they're just trying to pull it on to the tow truck. in the meantime police will remain there to investigate and clean up. i expect this will still remain closed for some time. if you are planning to head through this area, just want to stick to an alternate route and stay away from the area. dickerson west of i-270. 270 of course not affected by the accident. we'll keep you posted on this situation. a quick look on the

investigators in dickerson maryland are looking into a deadly crash that happened about 1:00 this morning on route 28. one person reportedly died after being trapped in a burning car. their identity has not been released on the cause of the crash remains under investigation. the quiet in an arlington neighborhood is shattered by ains. we were on the scene of the crime this morning on 10th street and george mason drive. four cars are broken into, the windows smashed, the air bags were taken from the cars. the vehicles were hondas and police are looking for the suspects. the trial of the former penn state assistant coach jerry sandusky is now under way. he arrived at the courthouse in pennsylvania this morning. he is accused of abusing 10 boys over 15 years. some of the alleged abuse happened on the penn state campus and also at his home. jury selection is now under way. >> all want to try to make sure that mr. sandusky gets acquitted and gets a fair jury to hear his side -- both sides of this case. >> legal experts say the case against him will hinge on the credibility of his accusers. san

well, that would be a question for john dickerson, our cbs news political director. john, how is this going to affect the presidential race? >> well, for mitt romney, it's turned out pretty well in the short term. the ruling's helped him raise $5 million already. though conservatives were well on their way to falling in line behind romney. now they're rushing to because only by electing him can they put an end to this law. but it's an open question how much mitt romney will be able to use this issue to woo voters will not already in his camp. romney's case against the affordable care act is muddled because in mrs., not only did mitt romney advocate a health care plan with an individual mandate, but it also included a tax on anyone who did not have insurance. you heard john boehner there complain about that tax. chief justice john roberts ruled that the affordable care act uses a tax in a similar way. that's what boehner was talking about. these similarities may make it too difficult for mitt romney to make the president's health care plan an issue. >> pelley: john, d

. >>> also in washington this morning, cbs news political director john dickerson. john, good morning. >> good morning, charlie. >> let's begin with the political fallout in terms of the candidates and the campaigns for the presidency. >> well, the political fallout here of the immigration decision is basically a split decision is beneficial for the president. he gets to talk about the arizona law, which is unpopular with hispanics. he gets to rally that group, which is very strongly in favor of him. governor romney was obviously trying to stay away from the issue during the primaries. he was anxious to align himself with the interests of arizona. in this case, he tried to keep all of the focus on the president, saying that this decision by the supreme court came about because the president failed to move on immigration and arizona had to take matters into its own hands. >> how does romney plan to handle this? because he was very strong in his appeal to conservatives in the primary, and now he's in a general election in which the hispanic vote is very important. >>

for those students of criminal procedure, you might remember dickerson versus united states where chief justice rehnquist departed from his previous pattern of casting doubt on miranda when congress had entered into the debate and said that, you know, miranda is only suggestive, it isn't compelled. we, congress, hereby pass an alternative to miranda. justice wren quest who for years had been casting doubt on the constitutional underpinnings of miranda said this is a constitutional rural. it's not a constitutional requirement. it's a constitutional rule. having created it, we, the supreme court having created it, i will not broke the congress undoing it. my thesis is that watergate was special in that it was like the congress attempting to take the miranda power or undo what the court had done. it was here the president directly challenging the judicial power, precisely in the context of a grand jury which was more judicial branch than executive branch and in a direct challenge that president nixon i suspect regretted that he gave to the supreme court. i could have burned the tapes, i wo
