it was very surprising, in this oral argument, to hear so much discussion of abortion and dobbs.usly closely related. in dobbs there was an argument made by myself and two other law professors that abortion restrictions violated the equal protection clause because they applied mainly to women. and there were distinctions based on sex. in a very short paragraph, the justice leader who wrote the majority opinion in dobbs dismissed that argument wholesale, that just because it is about pregnancy does not make it a sex based dissemination, full stop. that is the kind of logic the state of tennessee is using to defend this law, it is fiscally arguing that it is not a distinction based on sex, it is a distention based on medical purpose. and that is not a suspect category that would require the court to review this law more stringently. and again, this is an open door. there are lots of things that relate to sex based dissemination that have historically been justified on the basis of biology, like men and women are different. so if the court is simply saying that there is no sex based

you are that dobbs, the dobbs of jackson versus women's health.your name was on that case through no fault of your own, but through the dint of your job. how is it having your name on this landmark health case? >> it's been kind of a surreal experience, to be honest. it's not something i had any interest in being involved in. i actually had strong interest to not be involved with it. it's named after my predecessor dr. courier. >> if i'm not mistaken, she resigned. she stepped away perhaps in order to have her name removed from that case. and i wonder why you -- >> she had done a long tour of duty. that was plus to be removed from that. it's a risk of collateral damage. if you want to do good work in a red state where these sorts of challenges are, you have to take risks. >> you've worked in a very red state. you said that early on there was unity about how to respond, but then it devolved over time. in 2021, months before the delta wave, governor state reeves eliminated the mask mandates throughout the state. i wonder how you dealt with that. >>

we think that is a very dangerous extension of the dobbs precedent the dobbs precedent by itself. the court said, hey, this is just about abortion. don't worry. and here we see lower courts extending that to other contexts. we don't think it applies, and we're going to be interested to see what the court has to say about that today the timing of this offers something of a complication that i'm interested in. >> your take on the background for everyone is the court's decision to take this up and take up only the administration's the biden administration's case on this. the more i'll say more narrow just for everyone's argument, not the case that the families had had put up. that's created a complication, which is the government will almost certainly be switching sides in terms of their view on this issue, in case after donald trump takes office in january, this will likely be given. we'll see a decision on this maybe in june. how does that impact the case well obviously it's going to be up to the court to decide what to do, but i think that the court can and i expect that it will k

i recall when dobbs, the decision first came out overturning roe versus wade.se of the uncertainty that rule created. doctors refusing to even do some procedures that constitute reproductive health care if it could be seen as being an abortion and running afoul. we've seen women die because of that. what i worry about with this gender-affirming care, that laws could be pass that had could inadvertently harm not just transgender care for adolescents, which is important, but also hormonal and other treatments for everyone. whether they are trans or not. i worry about ongoing accessibility of hormone treatments used for everything from menopause all the way to cancer treatments. these aren't things i pulled out of thin air. attorneys for aclu and other advocates have flagged this in briefs in this case as a potential peril of a ruling that allows states to unilaterally with their own legislatures decide health care terms instead of letting it be between the doctors and their patients. >> yeah. you were talking about who has the final say in someone's health care.

well, now, two years after the dobbs decision, more than half of all women about 33 million live in states where abortion is either banned or limited. reproductive rights and law will continue to evolve, including under the incoming trump administration. kimberly mutcherson is a professor at rutgers law school, visiting at temple law school, and is an expert in reproductive justice and law. it's so nice to have you in studio. thank you for talking with me. thank you. sentiment around public support for abortion rights has increased year after year, increasing even as those rights have fallen dropped. i find that very contradictory. i'm not sure that it's totally contradictory. it's true that people will protect abortion rights, but often only to a particular degree. and i think that's a lot of what we're seeing now. so even in states where there were these ballot initiatives that said we're going to protect abortion rights in our state, those still had limitations to them. some of those states then voted for donald trump, who's been pretty explicit about what he's thinking about doing an a

we saw that after dobbs as an opportunity. we had seen a growing gender gap even prior to dobbs in favor of democrats, so could we expand that while also holding the line with younger men? we spent a lot of time targeting younger voters. we also wanted to make sure that the president's unique strengths with seniors did not exist only with him. that was a group he did very well with in 2020. that was a group that had very little erosion even in the rematch in 2024, so looking at seniors and she actually performed consistently with seniors as they performed in t-20. my-wise, it was those seven states with particular emphasis on the blue wall, but it really was younger voters who were disaffected. it was the ones who were more cynical. those who identify with the party are not necessarily angry democrats holding support but instead are sort of much more persuadable antiestablishment, cynical about government, cynical about how the last few years of their life -- >> were these all kennedy voters for a while? quits before the switc

look at the supreme court justices that he appointed, look at what happened with the supreme court's dobbs case, of course, that overturned roe v. wade. let's prep for that, basically. ali: and of course, there does seem to be a difference between what president trump is saying now and what he did in his first term, but what do we know about how he's going to approach this issue in his second term as it relates his first term? >> well, we of course have what he says, which is that he's going to leave medication abortion alone, and people access medication abortion the majority of the time. so about 60% of abortions in the are done by these two pills. u.s. so we know what he said. but i think it's also really important to know what he could do, which a lot of abortions rights activists have kind of flagged, to say he could restrict medication through the fda. he could enact something called the comstock act, which is a law from the 1800s, an anti-obscenity law that can essentially be used to stop the flow of abortion drugs, products that are helpful in abortion procedures. so i think there
