tory dunnan joins us from outside the supreme court. both sides are declaring a victory on this.hat are you hearing tonight? >> reporter: this is a complicated ruling. both sides are trying to claim a victory. >> i will now sign senate bill 1070. >> reporter: passing 1070, the law gives the state the ability tone force its own laws. months later the justice department sued the state arguing the constitution gives the federal government sole authority over immigration. today in a 5-3 ruling the supreme court agreed. >> this is a dark day for civil rights in america. >> reporter: the court left one critical element in place. it's a provision that lets police officers check a person's immigration status while enforcing other laws if they feel they have reasonable suspicion. critics say that could lead to racial profiling. today neither candidate spoke on camera about the ruling but the campaigns released vastly different statements. the white house hailed the decision but was critical of the provision saying no american should live under a cloud of suspicion just because of what the

tory dunnan joins us. somehow romney planning to go about this. >> reporter: he was talking with business leaders and ceo's about the economy. he was hitting the president hard, continuing to blame him for the issues. >> the reason it has taken so long for this recovery to gain traction and to put people back to work is in large measure because of the policy choices the president made. >> reporter: and, kelly, romney also pointed to the stimulus, the president's healthcare plan, the reason he thinks the economy is struggling right now. >> republicans clearly see an opening here given the economy has been slow. any of the polls supporting that? >> reporter: first, let has talk about 2008. one of the main reasons why president obama won the race is voters really trusted him, more with the economy than they did john mccain. right up before the election he had a 20% lead over mccain. this time around, it doesn't look like that will be the case. there's a poll. only 43% of voters have favorable opinions of the
