durbin-marshall is not the solution. it will create more problems, and i am very sensitive to small businesses. i have said to many people -- some of whom are in this room today -- that you've got a congress and a half to solve this problem, in my estimation. i don't have a whole lot of skills here, but counting votes and observing trends is one of them. this durbin-marshall bill is not going to pass in this congress, i think anybody realistic knows that. we've only got 1.5 scaramuccis of legislative days before we're out of congress. it's not going to happen. this is a good hearing. we're exchanging information. what i hope that we do here is recognize that small businesses have a legitimate concern. i will also say that every single one of those small businesses could take their swipe machine and throw it in the trash if they didn't think that they weren't getting added value for it. fair statement? so why don't we actually work on something that's not disruptive and doesn't repeat the mistakes of other countries who h
