it's a very meticulous search in the east river near 120th street. dive team members are searching the river bottom by hand trying to find the 40 caliber gun that was used to kill officer holder. officers did recover a knife that they believe may have been tossed in the river by accused cop killer tyrone howard. howard is accused of shooting and killing officer holder in east harlem during a foot pursuit tuesday night. he's a violent offender with 18 prior arrests and wanted for a shooting in september. of 19 people arrested in a drug sweep in east harlem. instead of being sent to jail, a judge placed howard in a diversion program. city leaders questioned how someone with howard's rap sheet could avoid jail. among those expressing concerns police commissioner william bratton. >> my understanding is he may have been held on a diversion program that if there's even a candidate not to have been diverted it would be this guy. he's a poster boy for not being diverted. it's unfortunate that there are people in our city, in our society that despite our best

nypd dive teams spent hours cowering the east river in year 120th street for the weapon used to murder officer rand paul holder investigators believe the suspected killer tyrone howard threw the gun into the river before his arrest. howard has been charged with the murder of officer holder. family members were outraged during the arraignment. yesterday howard was in court facing the judge allowed him to go to a drug diversion program instead of jail. back in may the 30-year-old pleaded guilty to selling crack cocaine but judge patricia one is decided to put off howard's prison sentence if he spent 18 months living and rehab clinic and six months at an outpatient treatment center. in late august howard stop showing up for the program and judge one has issued a warrant for his arrest, september 17th. manhattan district attorney's cyrus vance says he had opposed the request for diversion but respected the judge's decision. commissioner bratton and bill deblasio have criticized the court's decision. >> violent criminals it is appropriate that they be in prison. when you look at the offense

it was taken at the east river houses. the nypd says tyrone howard was engaged in a shoot out with these men in the minutes leading up to the shooting of 8:30 tuesday night. the two housing officers -- two housing officers on the roof of one of the buildings in that development. when they looked down and they saw the men shooting and called for backup. that backup was officer holder and his partner.

. >> reporter: police say last night officers responded to a drug shootout near the east river houses. holder and his partner met one howard on the 120th street footpath where he was fleeing on a stolen bicycle. >> he puts the bike down, pulls out his weapon and fires one time striking the officer in the front of the head. >> reporter: holder's partner wounded howard, who was arrested. it turns out police had already been hunting for howard in connection with the shooting of a man in east harlem this past september. >> the violent felony squad had the case. made numerous apprehension attempts. obviously, um, negative results. >> reporter: police found a .40-caliber gun clip in the water but still searched for the murder weapon. authorities are searching for reasons how a career criminal could be let out of jail again and again. >> there are some people that have to be in prison. and we need to work harden to ensure that they get to prison and more importantly that they stay there. >> reporter: now, a spokesman for the criminal court system actually says that howard was in his words a
