let me bring in cnn senior legal analyst and former prosecutor elie honig. a lot in this interview i want to ask you about. but first this trial date, initial trial date set what do you see in this? >> this is in all likelihood, a placeholder. it's just a date put on the calendar to mark it off. under the federal rules a defendant has a right to a speedy trial within 70 days of the first court appearance. if you go 70 days from last week it lands within this period. now, the prosecutor jack smith has already said, we're ready. we're ready to go, that's what prosecutors always say. the judge is saying i'm ready to go but the "x" factor is the defense donald trump. if he says i want my trial within 70 day, then we could well see a trial at the end of the summer. but that is very unlikely. he'll say i need more time to prep, i need more time to bring motions and try to drag this out. >> you have to say, it's understandable, at's why they're calling it a placeholder. they've got to get something on the books. everybody needs a deadline. obviously, it's necessary

let's bring in senior legal analyst elie honig to talk about this.'ve known about one grand jury in the trump documents case the one in d.c. but now we're hearing more from our great reporters about the grand jury in florida. >> i see two broad possibilities. one is this could be a convenience measure if there are witnesses who can't or won't travel outside of florida what you can do is take their testimony in a federal grand jury down there and take the transcripts and read it to your main grand jury in d.c. the other possibility is prosecutors could be examining the possibility of charging the case down in the southern district of florida. when you have a crime you have to charge it in one of the districts where some of the criminal conduct occurred. you have leeway but you have to get it right. if you charge in the wrong district, the case will get thrown out. >> so could it be some sort of criminal charge -- i'm just speculating here. some sort of criminal charge having to do with holding the documents improperly in florida and the obstruction of

elie, can you talk about what this would have looked like? you were a prosecutor, if you are sitting at doj and the trump team comes to you after you found these classified documents from mar-a-lago and says, look, let's strike a deal here. we don't need to go forward with this. we will give you everything you want. would doj have done that? >> it's all about timing. a i think at this point in this sequence here after the search warrant has been done in august 2022, i don't think there would have been a deal sohort of takig a play. if the trump team comes to me as doj and say we are going give you everything now that you have seven the place and you are going to go away, i think it's too late. there is a point of no return once doj has gone to a judge, said we have probable cause, did the search warrant. that said i think if the lawyers got through to donald trump way earlier in the process, before doj got involved, when it was just archives or maybe early on in the doj process and said, okay, sorry, there has been some bad communication here

what do you think, elie, how likely is this?ral sentencing guidelines and i arrived at the same number mr. sloman did. if you run the numbers here, it's not going to be a 400 year case. forget about the maximums, it comes out to 8 to 12 years depending on some of the wrinkles. now, the federal sentencing guide lines are not mandatory, so the judge has to consult with them, they're quite influential, and i think it's likely that a judge would go down from that number, but i don't see any universe where if this case results in a conviction of donald trump where a judge sentences him to something short of prison. it's possible, but i think even if a judge gives him a break, you're still looking at prison. >> really, you think he'd go to prison? >> i do. and i think it's a huge difference between this and the manhattan case. in manhattan, even if donald trump is convicted of all 31 counts or 34 counts, very likely given new york law and given new york practice -- >> be a fine. >> a probationary sentence, a fine, a non-jail sentence.
