but elon musk is readamant saying, this tesla range in cold is fake. here is no misunderstanding. he says, this is fake, made up. those are strong word. but this is the way that mr. musk, when he fields adamant about something, he responds via social media, on twitter. what is interesting about all this, if you talk with other journalists who have driven the model s, generally speaking, read the reviews, and i have read all of them. the general reviews are very positive. while the r may not be a hundred percent what tesla says it is, it never is for any vehicle, by the way. when you take any vehicle, whether electric or gas or hybrid, it is rare that you have journalists getting exactly what is listed by the epa. bottom line is reviews for the most part have been positive on the model s. >> yeah, you know, listen, it is a beautiful car, gotten good reviews as you said. when the new york times reviewer though, you know what the range is. you know the charging stations are. these are pretty strong words from elon musk saying, fake. long detour. saying he

it absolutely enraged elon musk. they looked at the data from the car and found that the driver had done all kinds of different things than what he claimed in the article itself. here's the block that elon musk posted. he doesn't post actual data but he makes a convincing argument that what you read in "the new york times" and what tesla's computer shows are not the same thing. that is a polite way of saying somebody is lying. of course we weren't there. we don't have access to the actual data so we can't say who is lying. this is going to be a disaster for somebody. one point aside from this huge fight that is interesting is tesla said "the new york times" writer turned the car's heater on. the writer says he didn't. why does it matter? heat in electric cars is a huge problem. nissan recently had to rethink the heater in the leaf. electric car motors don't make excess heat to be sent to the cabin so they use coils and that uses a tremendous amount of electricity. you can significantly reduce your range just by tryin

elon musk, calling a "new york times" article about a tesla test drive quote a fake. his case right here on cnbc. phil lebeau joins us now with more. >> this was quite the little back and forth between elon musk, tesla and "the new york times" yesterday here on cnbc. let's set the stage about what this all involves. on sunday "new york times" reporter john broder did an article, a test drive in a tesla. well, as part of the test drive, seeing how far the range is of that vehicle between washington and new york the vehicle stalled. it lost power completely. had to be towed. "the new york times" says the model range in cold weather fell well short of expectations. elon musk says the reporter john broder, he didn't follow instructions. >> we explicitly said that to do this trip he needs to make sure he's fully charged when he starts out. that he doesn't take detours. and that he drives at a reasonable speed. i'm not talking about, you know, some ridiculously low speed. i'm talking about, you know, at least not too far above the speed limit. and numbers three things were

that's far too long for elon musk. shorten that time. >> for the balance of this year, it's going to be generally at least few months that you have to wait in order to receive a model s. but i'm hoping that by the time we get into 2014, it will be a matter of weeks between ordering a model s and receiving it. >> and if you take a look at shares of tel tesla and we're looking at a one-year chart here, it has sold off yesterday. a couple of things to keep in mind, they had some parts delays adding to their costs in the fourth quarter. higher production costs in the forty quarter kept the profit margins from rising higher. they did swing positive, guys. they were at a negative 17% profit margin in the third quarter. now they are positive 8%. and elon musk says they will reach their target of 25% profit margin by the end of this year. so an important quarter for tesla, especially with them saying, listen, we are now profitable for the first quarter. we will be profitable and it will stay that way for the rest of the year.

reporter has answered all of the criticisms that tesla raised about the story, he says that elon must bei musk called him and he says i'm sorry the test ran was a disaster and yes, we probably should put charging stations closer together, which by the way, has huge financial i am mri caam-- implications for the company. and the times reviewed it well on the coast, whether or not it's a times bias or that there's a problem with the battery in the car that it doesn't do very well in cold weather. >> jon: taxpayers might want to pay attention jim, woo we have several hundreds of millions of our dollars invested in this country. >> one of the clean energy efforts that the barack obama administration put so much stock into. this from a communications point, this is a reminder why corporate pr people started audiotaping and interviewing the interview simultaneous with the reporter for, i don't know, 60 minutes coming in to do it and so on and this takes it to a new level. and the fact there's little black box-- in fact many have them. we know how fast john corzine was going, and this whole data and

elon musk with tesla, the ceo of tesla, said wait a minute, first of all, you didn't charge it all thebroder said listen, i went as far as i was told was necessary according to the people at tesla. so it's a bit of he says, she says there. and the other issue is he took a slight detour when he got to manhattan, and tesla is saying listen, you didn't drive straight to your destination. you took a detour which adds some miles on there. so ultimately, what people are looking at, they're saying if i get into the model "s," or any electric car, what is my range going to be? do i definitely have 285 miles, as tesla says? the fact of the matter is, it depends on a number of conditions. it depends on how cold it is. today it's about 38 degrees out here. that's not going to have a huge impact in terms of draining the battery. how much do you use for heating the car, the environment inside of the cabin? how heavy is it? all of those factor in. so, that's an epa rating of 285 miles. the next leg, becky, is 203 miles from here after we charge up over the next hour. >> it takes a full hour? >> you
