abc 7 news anchor eric thomas is live on the cal campus to explain. eric? >> reporter: you know they're very sensitive about sexual assault and harassment cases here at uc berkeley since they've had several high-profile incidents recently. today is one of those situations that shows you how tricky it can be to apply the law and to apply regulations when only the two people involved really know what happened. yesterday morning berkeley police came to the phi gamma delta house on the uc campus and arrested a member for allegedly sexually assaulting a female student back in february. but today the d.a.'s office reviewed the case and declined to file charges. the incident shows just how tricky these cases can be since they are built around new state law and university policy that requires both partners to say yes to sex. students like alex are taught that during freshman orientation as well as online. they're also taught about the rules when one party is drunk, high, or passed out. >> they said their consent doesn't count because they're intoxicated. >> reporte

i'm matt keller in for eric thomas. abc 7 news reporter alyssa harrington has been following the story all day. she just spoke with family members of the mom and daughter who are relieved they are safe tonight. >> i got off the phone with the mother of dana rinta. she wants to thank everyone who helped search for her daughter and granddaughter. dana rinta and her 1-year-old daughter scarlet were found safe and unharmed. they were reported missing yesterday, the same day fbi agents raided a home in san francisco's visitation valley. they arrested stanislaus petrov who is rinta's ex-boyfriend. you can see him handcuffed led out of the house by the fbi n put in the back of a police car. >> we know at some point in time they were, in their conversation we want to have with her. >> reporter: investigators want to talk to rinta about him. petrov is also seen in this surveillance video. he's suing the sheriff's office after deputies were seen beating him last november. petrov led them on a chase to san francisco in a stolen ca

i'm eric thomas. san jose police are investigating a double homicide. they found the bodies of a man and woman inside the home of lucas court. police have shut down the block as they gather evidence. they have not said how the people died or if there is an active search for their killer. >>> two police officers were injured in a crash in san francisco. abc 7 news was at san francisco general hospital when the officers arrived. they were in a patrol car that collided with an suv. the officers were taken to the hospital to be checked out. police have not said how serious their injuries are. >>> a police helicopter pilot in riverside is credit with preventing a tragedy on the railroad tracks. take a look at this image taken from the chopper last night. a truck was involve in a rollover accident. the pilot flue above the train to spotlight the engineer to stop the train. the train stopped about 40 feet short of the truck. >>> strong winds have picked up in the bay area tonight. the winds already started causing problems in the great highway this afternoon.

thank you for joining us, i'm eric thomas. let's go to sergio quintana who is live with the breaking details. >> reporter: this is a search that has been going on for a little bit more than an hour or so. we have been keeping a close eye on the command center. it's encircled in crime scene tape because there's a whole bunch of agencies there coordinating amongst each other. the fire department, the police department, and the national park police, and also the coast guard. let's go ahead and take you out to where they're searching on the surf there at ocean beach. there are multiple ships and motorcraft from the agencies. earlier when we got on scene, we did spot three young men, about 17 years old or so, those three men were in a group of five people who were here at the ocean -- at the beach. they got swept into the water. those three young men were able to get out on their own. unfortunately, there are still two young men that are still in the water. i talked very briefly with the woman who saw as firefighters arrived, to he

i'm eric thomas. thank you for joining us. we begin with developing news. a full-scale search for a missing teen from solano county end a short time ago win she was found safe. cornell bernard is live in vacaville with details. >> reporter: good news. she was found safe and sound, not far from her home in downtown fairfield. she appears to be okay. the search for her was happening here in vacaville's lagoon valley park, about seven miles away. she was considered an at-risk missing teenager with mental issues. police say she left home to walk her dog last night about 7:00 p.m., and never came back. there was a full-scale search with search teams from the bay area and the central valley looking for the girl. her dog was located this morning okay by a hiker. the dog was tied to a tree here in lagoon valley park. unknow how the dog got here. police are happy that hailey is okay but have a lot of questions. >> there are number of questions. obviously a lot has happened since 7:00 last night, and there's strange circumstances here. so, our investigators are going

i'm matt keller in for eric thomas. >>> a drug overdose problem blamed for nine deaths in sacramentoas reached the bay area, redwood city fire said they have responded to overdoses involving the drug fentanyl. in most cases the people did not die. investigators say people believe they are buying norco tablets on the street. it's a mild pain killer, instead they have fentanyl, which is 100 times more potent than morphine. in sacramento paramedics have responded to three dozen overdoses and nine deaths in a week. our sister station in sacramento spoke with the sister of a victim today. >> the fake norcos, to relieve some pain, i hope it did but he didn't take that, knowing that he was never going to wake up again. >> on friday, federal authorities issued a public safety alert been the drug. last year several deaths were linked to fentanyl, masked to look like xanax. >> a open for vandals damaging 120 vehicles using bb guns and have now turned their weapons on people. san leandro showed a video with a suspect it shooter. cornell bernard has more information.
