they've read his book, they like is tax policy and evan perez making the point that new york city is, is more diverse than perhaps people like to think that it is. what do you think the odds of the court granting that change? >> venue requests are i think it's slim to none. >> if they grant the change and remember that one judge has already decided that the court the trial would go forward. and so the trial judge then continued on selected this juror with the lawyers and as you say, there was a great deal of back-and-forth during jury selection process about meet social media posts, feelings about the defendant, feelings about the government. so some of those things cut in trump's favor. so now there's panel of appeals court judges will be essentially saying, well, look, lawyers didn't you have a chance to find out, hadn't you? didn't you have a chance to use your strikes, didn't have a chance to talk to these perspective jurors. so tell me why you think this is going to be impact his right to a fair trial. look at the jury makeup here. >> so i just have a hard time believing that the

cnn has reached out to fox news for comment here with me now is cnn senior justice correspondent, evan perez thank you for coming in. so let's just talk big picture about the strategy here for years hunter biden really didn't say anything for lots of reasons. but the biggest reason is because his father's political team didn't want to write, they just wanted to kind of ignore it, and what happened was it continued to snowball snowball, snowball, snowball and for lots of reasons, the strategy has shifted now on he's, he's pushing back these pushing back very strong and look, one of the things that he's also done is i've you've seen you see how he is tussle with the republicans in congress showing up to their hearing demanding that they do a public hearing and then over time, finally negotiating for him to come in and do a private deposition. so you've seen him sort of fight back after after a period where the specialty, the white house and the president's advisors would have preferred a hunter to just stay quiet and just not give more oxygen to some of these allegations. now for that part of

thanks so much, paul, let's go to evan perez right now. who's also i believe outside the courtroom. evan, what does this mean in terms of what happens tomorrow? >> what jake right now, they've only seated one of the potential one of the alternate jurors according to our team in the courthouse, by the way, are carrots canned. i'll just read back in there to help do some more of this reporting but what we know is going to happen according to the judge, is that he's going to continue this process tomorrow. we don't know exactly how many alternates, but the day inclination that we had are one indication we had because it was gonna be about six alternate jurors. obviously, given the stakes of this case, and the amount of trouble we've had it's probably smart for the judge to have as many alternatives as he can in order to account for any issues that might arise over the next few weeks at this trial goes on and so he's being very, very careful. he says he's going to continue this process tomorrow, is not going to go through the questionnaire, so we're not going to hear any more about those

evan perez is out front live. he is outside the courthouse here in new york. and evan, just how prepared are both sides if this jury pool does not stick? >> well, you know, erin, neither side really had any hesitation about using their challenges, their strikes to remove jurors that they thought should not be on this jury. and so we've heard from the judge today, it appears he is going to allow each side to have additional checks challenges in the next set of alternate jurors that he is set to choose. now, we don't know exactly how many he's going to choose we heard initially that perhaps as many as six alternate jurors would be chosen. that's a process that is going to continue tomorrow, but today, obviously, things as you pointed out got to a very slow start and then in the final hour is when we finally saw bursts of activity and we got all 12 jurors plus the alternate chosen. now, despite the complaints from the former president about the unfairness of this process, what you're seeing in these 12 jurors is a cross-section of new yorkers. you're seeing an inv

like they're gonna move on it quickly and make a ruling and move this january 6 case for either evan perez is out front, so evan, i guess that's the confusing thing. >> it appears clear how they view it, but in this in the specifics of this case, they want to they want to be very narrow and specific. so if they in this immunity issue back to a lower court what does that happen? what does it do? the timeline the timeline is still very, very complicated. >> there's very, very little room for judge tanya chutkan to maneuver era. and because we're looking at a ruling likely at the end of this term for the supreme court, which ends typically at the end of june, it is possible they go into the first week of july, but here's the deal. it once they rule and if they ask the judge to go back and review the specific acts to determine which is an official act which is not, then there might be more legal proceedings for her to oversee. there is also a possibility that donald trump will try to go back and try to appeal some of those decisions. now, it is very, very possible still in the realm of possibi
