today a federal judge paved the way for thousands to join the lawsuit saying the police are showing "troubling apathy toward constitutional rights." we asked jim axelrod to take a look. >> r >> reporter: 23-year-old nicholas peart the, two weeks from college graduation and never in trouble with the law says he's been stopped and frisked by new york city police a half dozen times in his harlem neighborhood. what's that feel like when you're stopped and frisked? >> you just feel a sense of hopelessness and that, you know, you're less than human. >> reporter: peart is a witness in a lawsuit charging the policy that allows n.y.p.d. officers to detain anyone they find suspicious discriminates against minorities. last year 685,000 people were stopped and frisked. 84% were black and latino. 88% of those stopped were not arrested nor given summons. the judge's decision to grant class action status allows thousands to join the suit, targeting the policy itself and not the action of an individual officer. what does it mean to get this kind of... for a judge to say, hey, this has probably happened to many people who will never sue. >> i think it says that we can have faith in the la
