protesters around the country were out for a third night over a grand jury's decision not to indict a ferguson city police officer. demonstrators warmed the streets. they lit dumpster on fire and some vandalized businesses. more than 30 were arrested. susan mcginnis is in ferguson. susan, good morning. >> reporter: anne-marie, good morning. it could be the weather. it could be the holiday. but the protest here was decidedly smaller but the protesters were out. the protesters are showing great fortitude. it could be the weather, but this big group is showing great fortitude. as members of the national guard secured the police didn't with weapons at their side, crowds of protesters braved the snow around with flags and signs in honor of michael brown. others marched down the streets creating travel disruptions but it was a far cry from the first two nights after the grand jury decided not to indict darren wilson for brown's deathing. >> at the same time, rioting and looting is unnecessary. >> reporter: here in ferguson, demonstrations were mostly peaceful with only small protests. police and national

it's not the entire city of ferguson. it was about a four-block area that was a center for trouble. >> thanks so much for all of this context. it's so helpful. thank you for being out there today. joining me now is the president of the naacp legal defense and educational fund. if we needed a smart lawyer, former law professor, it's today. help us to understand first of all the use of the grand jury here compared to other jurisdictions. i understand that a grand jury can be used, but in this case the prosecutor really conducted a trial in the grand jury for all of these weeks rather than a simple proceeding to establish probable cause. >> thanks, andrea. i am not sure he conducted a trial. a trial has the feature that is absent from grand jury. there was no cross examination. i heard people talking about the compelling narrative presented by officer darren wilson. narrative is only compelling until it is subjected to cross-examination and someone has an opportunity to test the assumptions and the statements that were made.

ed is in ferguson today. the city's mayor, james noelz, held a press conference earlier today. i know you are right near an outdoor church service because the church was burned during the unrest in ferguson, but what, if anything, are people saying about the resignation and about the mayor's words? >> the raexz is it took too long. especially for those that have been very critical of the police department and darren wilson's actions back in august. you know, it's interesting. the mayor did point out a couple of tidbits and the press conference that occurred a while ago. he said he didn't receive the resignation letter from darren wilson or his attorneys until several hours after it had been made public in news reports. kind of expressing some frustration with the way that was handled. the mayor made a point of making it clear that darren wilson would not be paid any kind of severance, and all the ties have been cut off immediately. one of the other things that was interesting as well is darren wilson's lawyer said last night that there had been threats made to the city of fergus

is escalating the fear and concerns in the entire, you know, st louis community, not just the ferguson city, but the surrounding areas as well. so i think there needs to be sense that, you know, the police will respond to anyone that is violent or anyone that commits a crime, but has to be sensitive to not, you know, escalating the fears of people, or provoking protesters in the way that we saw after michael brown's shooting. >> is it legal to call the state of emergency when one hasn't happened. >> i think the governor had the power. the legislation in missouri gives him the power to do so. the question is how does he use the power. does he use it to bring the community together are or in a way that polarizes the community. we saw horrible images after michael brown, after the shooting of armoured trucks and tear gas and batons used. we are hopeful that this time that communications between police and citizens don't lead to that escalation. >> you have been watching this since the violence broke out in ferguson some time ago. ish you are from the st louis area. give us your thoughts? >> fi

but in ferguson, up with of the city's institutions has stepped up to help. this is the ferguson municipal library which is located on florissant road right in the heart of the city's downtown, down the road from the ferguson police department where a lot of the action the last two nights has been centered. yesterday, after the worst of the unrest, ferguson library made a point of being open. they tweeted out early in the morning that they would be open all day with wifi, water, rest and knowledge. library staff was in place at 9:00 a.m. with over 50 volunteers, 50 parents, teachers, retired folks pitching in to help giving out free lunches to school kids, even having story time for some of the younger kids. the library held what they call an ad hoc school day. they did this for a week back in august after the ferguson school district delayed the start of their school year because of the protests on the streets back then. back then and now, the library invited invited teachers to come in. yesterday the library also opened its doors to local businesses. staffer
