as you know, hurricane irma had a tremendous impact on florida, even on central florida where i represent. thousands including medically-vulnerable individuals were without power for several days. homes in the orlo vista area in the orlando area were flooded. though many lost their possessions they did survive. we're certainly thankful for that. while you were not the director at the time of hurricane irma, it is my understanding that you did serve as the chief of staff, a position that did in the exist prior it your service i believe. and as a chief of staff, i am sure you are aware of the needlessly tragic events that resulted in more than a dozen deaths at the rehabilitation center in hollywood hills. as a floridian who has weathered my share of hurricanes, i understand that the power goes out. mine did as well. and it can take some time to be restored. we do have to be reasonable and understanding in that area. but i also know that vulnerable populations like seniors and seriously ill or mobility restricted individuals require accomodations that you or i would want certainly if we wer

what -- what would florida law allow at that point and was florida unique in not having assigned judges for indigent defendants? >> so florida law at the time only allowed for the appointment of counsel in a narrow band of cases principally capital cases or death penalty cases. they work alone at that time in to roviding counsel indigent defendants, poor defendants. they were in the minority at that point and the trend of to history was clearly going against them. so i'm not sure about the precise number. but i think you were down to about a dozen jurisdictions that didn't provide counsel in all cases to poor defendants. >> it was even more dramatic than that. so two things, one, yeah, the judge is trying to help gideon out a little bit. but it's very difficult to be a coach and the umpire. and some folks who say, gee, the constitution doesn't say appointed counsel. true. the founding the founding actu framers only provided for appointed counsel in death penalty cases. but in the other cases, the judge was actually supposed to help the defendant. but as time went on, it became clear tha

where the florida supreme court is that they are not. florida supreme court and the u.s. supreme court, purporting to basically follow this name set of principles as betts v. brady, but they keep disagreeing. the last time i think the supreme court had ever upheld someone who had asked for counsel and did not get it was 1950. so hugo black and the lawyer for tiss said thatr this case-by-case system was not working well. but it was worse for the state because i'm a when we overruled a state decision several years after the trial, they would have to retry the person. you would have to put humpty dumpty again. the witnesses are scattered, the -- let'sis scattered just have a roof from the beginning. there will be a line, serious cases versus traffic cases. this one is illiterate, underage, who is feebleminded, whoever. -- let us have this same rule from the beginning. susan: so the court agrees to hear the case in the early part of 1963. let's take a look at the nine members of the supreme court who were destined to hear the case. we talked about earl warren and here are the

i grew up in florida. still represent florida. served as first responder. so i'm no stranger to hurricanes. fema denied about 23% of 2.9 million applications for individual assistance after hurricanes harvey, irma, maria with majority of those denials being in florida. several of my constituents say they have been rejected for technical its. typos or omitted document. rather than plain language request, they received a four-page denial. my office assisted one of the families homes that was destroyed by patches of toxic mold covering every surface. but because they missed one insurance form they faced termination of their transitional housing assistance. foch fortunately we were able to help them with their application and they qualified for additional 18 months of continued rental assistance. my question is, how does this denial rate compare to prior disasters and what factors might explain the difference, if any? >> i don't know where the rate compares, one one of the problems that we have is we immediately go out and say, call 1-800-621-fema. we blanked c

the legislation passed in florida is a good start. and there must be more done to secure our schools. legislation being considered in this body will continue on the efforts begun in florida and i call on congress to pass this legislation follow the lead of what has been accomplished in florida, build on common ground. but it is not the whole situation. the problem of man against evil is as old as humanity itself and we cannot face it alone. if we think of school violence as a disease we would not just treat the symptoms or only don protective gear to avoid accidental exposure. we must learn to identify troubled youth before they become violent and get them the help they desperately need. we can look to programs like safe ut program in utah or work done by l.a. county schools to identify potential threats. even u.s. secret service studied school shooters and defined six common characteristics which can aid in identification and introduction. i accept this in elena's name and i will see it through. ultimately the solution is not in any
