cases because you just wouldn't be able to get to the majority candidate but the driving force and foley's new book on this is really fantastic, the driving conception especially after the 12th amendment was to drive towards a majoritarian president. one who was not a fractional 33% but really was somebody who could be thought of to represent the majority. the other part about this is you know it is really important to recognize that when the twelve, we've had two electoral colleges, the one the framers gave us and the one after the 12th amendment. those are very different institutions they expected very different presidents. the first electoral college expected george washington types. after the election of 1896 people realized there was no gonna be george washington types anymore. so then we had the really contested political party president. that's what the twelfth amendment tries to adjudicate but what's striking about the twelfth amendment is when the 12th amendment is debated we, have already had so-called faithless electors or we've had, we have already had independent judgment by e

one of the things an election lawyer said to me, and it was maybe ned foley or others, he says the recipeccessful litigation is you get a lead and get in there to get them to, you know, stop once the count is certified. so you defend it. but you can't litigate from behind, you know, a bunch of votes. what do you think of this strategy we've seen displayed here? >> it's a strategy of desperation. i really think it's really about sowing seeds of disinformation through the sticky tack litigation around the country. the litigation is frivolous, it's baseless. and even if -- but the interesting thing here is the trump campaign neither has the law nor the facts on its side. it doesn't have the law on its side and today's 1.5 page order by justice alito to double down on what pennsylvania was already doing, it amounts to really nothing. but they also don't have the facts on the side. so even if they have the law on the side the votes at stake in many of these litigations wouldn't change the outcome of the election. i think we have to call this for what it is, this, to me, really is a last-minute

that's right foley that's the accusation of democrats who pointed to efforts by texas republicans the latest being a lawsuit that was filed in federal court seeking to invalidate 127000 ballots that had already being cast many of them had tried in polling locations like this one behind me in the argument of those republican activists was that because the ballots were cast from a card which of course is an accommodation given the pandemic they argue though should be illegal will the conservative judge in that case tossed it out giving a win to democrats and in typically a year of $127000.00 votes that may not make a big difference in texas which is reliably red having supported only republican presidential candidates going on for decades but perhaps this year that number of votes might make a difference because joe biden is polling just 3 percentage points behind president bush is within the margin of error and certainly even if he does not win texas today most political experts are saying he probably won't even if he comes just close or even if he does come in just 3 percentage points

tom is in foley, alabama. caller: good morning. happy thanksgiving. i would like to point out a few things. i'm a simple man. retired, no high school education whatsoever, but i made it through to retirement, 30 years of work. how is it possible that we change our election laws months before the election and we have millions more votes than four years ago? it is baffling to me. like i said, i am not a real educated man, but i know how to do a little math. something is afoot. i have friends from mexico, el salvador, immigrants. of course they came here with a were young just to get a job -- here when they were young just to get a job. i know this is what they believe. why would anybody want to leave somewhere else to come to america if everywhere else is so great? america is great for one reason -- everybody has a chance. i would like to leave you with that. thank you. host: this is briley in texas. caller: lord bless you. i am thankful for this nation. one nation, under god, that is what i am thankful for. i am thankful for my family and i'm thankful
