i'm frank mallicoat. nearly 6:00 on this black friday. we begin with some breaking news this morning in san leandro. a man was shot outside a walmart store. gil diaz is in san leandro where the store just reopened. >> reporter: good morning. just reopened probably about a half hour ago. people are being let in but this portion of the parking lot is closed. investigators still hunting for clues in the case. it happened at 1:50 a.m. here's video of the scene from above taken by chopper 5. it's a robbery gone wrong according to police. the victim and his group, whether family or friends, coming out of walmart with a cartful of goods going back to the car when a group tried to rob them. the family, friends and family, tried to fight off the robber and one person was shot. that person is in stable condition. we don't have his name or age. the group with the victim detained one of the robbers. they don't know whether that person in custody is the shooter. this happened on black friday. a crazy day for shoppers. here's what police say you should

i'm frank mallicoat. >> i'm grace lee. it is 5:29.begin with a nasty odor out they east bay showing no signs of letting up. >> i guess it's pretty bad. hazmat crews have been working through the night to fix a broken crude oil pipeline at the concord naval weapons station. the strong sulphur odor even chased some of the folks out of their homes and kristy seifkin is now in that neighborhood and she joins us now with a little bit of an update. it's still pretty bad out there i guess, huh? >> reporter: yeah. we have kind of done the opposite of what most people are doing. most people who live in this area are leaving because that smell is so bad. the leak has been contained but definitely can still smell that rotting sulfur in the air. it was too much to handle for people. they packed up belongings many of them leaving for hotels in the area and several of them had reported smelling this for actually a few days as early as thursday. it turns out that that actually was the broken pipeline that they were smelling, the oil coming from that

i'm frank mallicoat. we will get to those "occupy" protests in just a moment. first, today the state's highest court handed down a ruling that will change the course of the prop 8 legal challenge. gil diaz live in san francisco now where the ninth district court will decide whether to implement that decision. >> reporter: the supreme court decision was made public this morning very discreetly online around 10:00. there was no pomp and circumstance behind me among the courthouse steps except for a handful of prop 8 opponents with their protestor signs. they have since gone. one couple here were the ones suing the state to overturn prop 8. they were disappointed by the ruling but they are also relieved. chris and sandy were hoping for the best. the california supreme court ruled that supporters of prop 8 can proceed to appeal on their own judge vaughn walker's ruling from last year. he ruled that prop 8 was unconstitutional. the berkeley couple suing the state to overturn prop 8 respects the court's decision. >> and this ruling despite the fact that it's not what
