a parole commissioner sent geovanni ramirez back to prison for a weapons charge.awyers say they are gonna fight that decision. >> reporter: today's decision that geovanni ramirez did violate his parole buys more time for lapped investigators. he still is not charged in the beating of brian stow but, now, he'll be behind bars for at least 10 more months unless -- >> the fight is not over. there's an appeal process that takes place. i likely will be submitting an informal decision review. >> reporter: the decision by the hearing officer is that ramirez had access to a handgun. not possession but access. and, in his view, that's enough to accepted him back to state prison, the gun was found buried under clothes in a dirty clothes hamper in the apartment where ramirez was arrested. >> they cannot pin the gun on him, it's not his gun? >> as far as i'm concerned, it was -- he wasn't in actual possession of this fire arm, and again, this -- there's an issue about whether or not he even had any knowledge of whether it was inside of the residence. >> reporter: no comment t
