i know that justice ginsburg would love us to start over again, but that e.r.a., almost 100 years in the works, we believe it was ratified on january 27 and that is the date we are working with. the thing that we stumble over is the timeline, what used to be the deadline, but would like to think of it as more of a suggestion. and thenmit of seven t usedrs was in what to be called the preamble and now the joint resolution. it is not something 38 states voted on. that is where we believe we are in the clear to say that we have met the requirements of the constitution, article v. those two things that are required. that time limit and this department of justice and this legal memorandum have stopped us and have put us into the courts. the attorneys general of the last three states that ratified have, of course, started to compel the archivists to publish the equal rights amendment. we always say we have a great deal of sympathy for the archivists, the head librarian who probably thought he had another life, a career. who's's the one responsible for giving equal rights to millions of wom

. >>> joining us is ben ginsburg, a long time republican election lawyer and cnn contributor. first of all, happy new year. >> happy new year. >> thanks for waking up early. is there any foreseeable path for republicans to actually stop certification? >> no, there's not. what happens if there's an objection to the electors from a state, and both a representative and senator agree to it, then the body separates. so the senate meets and the house meets. the house is controlled by democrats, the republicans currently have a very narrow majority but enough republican senators have said they're opposed to this. >> it's so rare for us to even be discussing and focussing on this because typically it's just sort of a procedural repetitive things that happens, i'm curious, why does congress have this role? what are the laws around congress certifying the election? >> the law is because there needs to be a central counting place for the electoral college and it's always been a ministerial duty. this opening of the electoral slates from the states has been done in as little as 23 minutes

o ginsburg so i think that the democrats now will be taking some narrow leadership at the house meaning that they will have more fiscal maneuvering room and also somewhat more maneuvering room confirming people to various kinds of appointments including judges by the way. so a whole range of things now become possible for a president-elect biden. one should be cautious though about overstating this it is still a u.s. senate that is divided 50/50 and so what the president-elect will have to do is be careful to listen to moderates on both republican and democratic side moving forward >> exactly and that was the next question i was going to ask you about, the fact that the democrats are looking at a very slim majority, 50/50 in the senate with vice president kamt the tala harris e tie-breaking vote. so to get legislation passed, i would expect they will need some buy-in perhaps from republicans as well. what is most likely to get through in terms of joe biden's policy agenda, where could he find the most support? >> i think a couple different points there in the arcane rules of the u.s. se
