and steven gonzales, a constitutional law professor at the phoenix school of law. kris kobach, we've heard both sides here, as it were, claim victory based on this ruling. kind of the split decision of the supreme court, as it were. what is your thought about that? was this stop-and-check provision that was upheld, was that the heart of the law in your opinion? >> yeah, i think so. it certainly is part of the law that has the greatest scope so when arizona claims victory, i think that's correct. it's a qualified victory for the states. the that has greatest reach. put it this way. that provision will kick in in thousands of law enforcement stops every day throughout the state of arizona. so it has a great reach. the other provisions are less significant. for example, the part criminalizing the illegal seeking of work. that's only going to be relevant if a county launches an investigation of a particular employer and then they discover certain unauthorized aliens who have broken that law. it's much narrower. the big one was the one that was upheld today. i think tha

richard gonzales, reporter with national public radio. jerry roberts, calbuzz editor. joining us from sacramento, dan walters, sacramento bee columnist. jerry, there are two major issues that are game changers in this election. one of course is redistricting. the other is this top two system for choosing a winner. explain the last one because it seems to be the most confusing. >> well, belva, as you know, historically the primaries in california and elsewhere have really been a very decisive vote because we had a gerrymandered state because the districts were either overwhelmingly republican or democrat as a general rule. now the parties get thrown out the window in the primary. so whoever finishes first and second, regardless of what primary, will go onto the november election. the idea, of course, was to try to get more moderate voters, moderate representatives up in sacramento and washington. it's really the first test for it. it's kind of an interesting experiment in political reform and one that the voters approved overwhelmingly two years ago. >> this is a system

attorney general alberto gonzales. mr.>> good to see you. >> let's start with the justices' decision on immigration. the supreme court struck down most of the immigration law but uphold the "show me your papers" part. if you were on that bench, what would you say now? >> how would i have voted? >> yes. >> well, i think i'm not surprised that the court said that preemption prevents arizona from regulating in this area. immigration for policy is what i've generally found deference to the federal government. in that sense, i'm not surprised. with respect to the decision that was upheld, basically what the court is saying, it's still too early to tell. without knowing how the law is going to be implemented, we really can't say one way or another, whether or not this state law is preempted by federal law. >> but let me ask you, if this goes into play, how do police avoid racial profiling? >> well, the issue of avoiding racial profiling exists with respect to a myriad of state laws that are already on the book and have been on t
