reporter: the gun used to kill gregg smart will remain in state's evidence, and prosecutors say there's a very good reason they need to keep it. it is perhaps the most infamous% handgun in new hampshire history. and a judge ruled that it will be staying in a state evidence room for at least the foreseeable future. this after the father of advance latimy jr. asked for the return of his firearm, according to paperwork filed at rocking hall county superior court. it's the .38-caliber revolver that prosecutors say william flynn used to kill gregg smart back in 1990. >> his weapon was taken by his son, essentially stolen and then used to kill a man. so because of that, the weapon went from something that was just a gun in someone's home to a piece of evidence in a murder case, a murder weapon. so that's why we've asked the court to allow us to retain it. reporter: advance was one of fourteens at the time convicted convicted in connection to the homicide. orchestrating the crime and is serving life without parole. a lawyer for advance latimer says the gun is lawfully his and after 25 years it
