secretary griswold, i'd like to start with your thoughts. on just what we heard in the last hour or so, these breaking comments from trump tonight. i should say on his social media that we read, attacking fulton county election workers, just as their office is receiving a letter containing fentanyl. one that the secretary of state in that state called an act of terrorism. >> i would say donald trump's disgusting. he is the furthest thing from a patriot, and a leader this country has ever seen in the presidency. you know, honestly, donald trump has opened mega extremism, which has put us election officials under threat. in his words, will cause threats to election workers in fulton county. and we are already having to contend with letters full of powder, some fentanyl, gunpowder. we are already having to contend with this conspiracy, the lies, the constant [inaudible] people like donald trump endlessly taking it up. he wants to scare good election workers out of their jobs, so he can put extremists in to help him steal elections. it's an amer

that is a finding that, as secretary griswold said, it is historic. it is entitled to a great deal of deference, because it is based on the evidence. it's based on the adversarial process. so that's incredibly significant. she also made this other legal ruling, which you've talked about, that the president essentially is not an officer of the united states. that is something -- that's a legal ruling, surely on the law. it's not based on that evidence. and because of that, when this goes up on appeal, as the tech jerry said, our clients, there is republican and unaffiliated voters, they're going to appeal it. that's something that the colorado supreme court is going to consider a fresh, and we've heard from experts like the folks you've had on, esteemed progressive legal finger, professor tribe. esteemed conservative legal thinker judge luttig, who think that this -- they disagree strongly with that legal finding. that's something that the colorado supreme court is going to consider a new, even donald trump's attorneys in his new york civil case have s

secretary griswold, thank you so much for joining us.n reading all the clips and trying to make sense of what this all means. let me start by just asking you what your reaction is to the ruling and what this means in colorado. >> first off, having the court say that the former president engaged in insurrection is a big news for the entire country. donald trump is a danger to american democracy, and that is something that is really novel about this case that the judge decided that. but ultimately, she has ordered me to put him on the ballot and i will of course follow whatever court order is in place by the time they certify the ballot. >> the judge found, and this is what's so interesting, it's significant, i'm not a lawyer, but that the judge did say he was involved in the insurrection, as you just said, the judge also found that trump as president was not an officer of the united states. did that surprise you? >> honestly, yes. the idea that if you are a soldier or a congress person, a u.s. senator, that if you engage in insurrection,

everyone sort of accepts griswold, i am not sure that would be the best idea for the court to go down that route. another way of thinking about my suggestion about president's we would cut back on precedent. we are not going to for instance develop some idea of substantive due process on which it may depend. so we are going to back in some way. that's another possibility. those are two different kinds of ways of limiting precedent. i'm not sure how we would do it in each of those cases, but they are very different. one is a way of changing the rule only for the future and the other is not changing the rules for the future, changing the rule also for the past but cutting what the supreme court has done back to a place where it really isn't going to create many huge reliance costs but will be closer to the original meaning. >> we are really out of time. i will take one last question from the front. lightning round. >> stare decisis really means standby the decisions and don't disturb what is settled. if settled precedent is the starting point, does that create a better analytical framew
