is this a good bet for heller? >> it depends on the demographics of nevada. there's a big trump factor in nevada. it doesn't really play in swing states the summer like that where there's a lot of big business ties, las vegas, and a lot of industry as well. and of course, he thinks it is a winning strategy. >> speaking which the president is predicting a red wave in november. so let's talk again about which accomplishments the president can tell to fuel that red wave and should the democrats be worried about getting washed out by a red wave? >> i think is pretty safe to say democrats should not worry about a red way. the whole blue wave ideas kind of it ebbs and flows. we are not sure if there will be a blue way. in terms of right now, it is a mix. you will see droplets in different areas. i think california and republicans are vulnerable are poised to do really well because they have the gas tax repeal on the ballot. you look at somewhere like florida, rick scott is pulling way ahead of bill nelson. that is positive for him. but it really depends. a red wave

that's because he didn't get his way when the court ruled in the heller case. justice stephens said the second a moment -- amendment means you have an individual right to bear arms in the militia. let's say that again. of course it doesn't say that. do you have a right to be in a militia of? do you have a right to do anything you want to do if you're in any oteri course? that was more or less contrived than it did when the day but obviously was close. it was 5-4. justice breyer had a balance he wanted to hold in the case where whatever the legislature did you uphold anything they do because they are more able to understand what is constitutional and what is not. like, really? legislatures and do you say that on other issues? no. so the day after that decision came down the district of columbia of federal jurisdiction and therefore the 2nd amendment applies there and the next question was does the 2nd amendment applied to the state? and by the way i'm done some other litigation in the state. e travelers from other places, they don't understand. they come in, the

we need to hear from the supreme court just like in the heller case which says the second amendment is not absolute. interesting enough in the ninth circuit case in 2014 the us supreme court had the opportunity to stay the 10 rounds law and justice kennedy's opinion did not. so that is all we heard from the supreme court on that. they need to step up and clarify this for the nation. jillian: do you think they will? they turned away a lot of appeals that would answer these questions, justice thomas writing a dissent said they treat the second amendment like second-rate or second-tier constitutional right. it should be on par with all the rest of them. >> the supreme court has not taken up any case since heller in 2008, they need to, they have turned down a number of challenges recently and potentially changing membership on the supreme court may break the logjam in terms of getting these issues there over the next couple years. shannon: i will be back monday for opinions and any announcements justices like to make, thank you very much. >> you are the jury, let us know. if you have a law
