what should we be listening for on day one of oral argument there is at the high court? >> reporter: craig, in the last hour the supreme court has been hearing oral arguments in the aca case, obviously extremely consequential. health care access for about 20 million americans hangs in the balance, pre-existing condition protections. one thing to watch for is whether there are five votes to validate the law. very skeptical that the individual mandate is constitutional. that could potentially be thrown out. that has no force of law because the penalty for non-compliance is zero dollars. what's more important is whether they believe that provision, if declared unconstitutional, should take down the rest of the law with it. at this moment, the expectation from legal experts is that the three democratic appointed justices on the court will vote to uphold the law and chief justice roberts who believed the mandate was constitutional in 2012 is likely to uphold the law. that leaves one republican appointee that needs to side with them to make sure the law still stands. i want to
