welcome to the markup of the fiscal year 2021 funding act for the department of homeland security. i'd like to begin by thanking ranking member fleischman for his collaboration in putting the bill before us this morning. there are, of course, areas of disagreement. almost entirely in the immigration area. i do believe, however, that most of our bill represents a bipartisan agreement, but i don't want to minimize the disagreements on immigration, they are significant and they are important. before discussing the bill, i would like to acknowledge the department's personnel who work on the front lines of the coronavirus pandemic. many have contracted the virus and sadly several have lost their lives to it. we owe them and their families our sincere gratitude. i also want to recognize the pandemic's impact on migrants, particularly those continuously held in detention facilities. many have also contracted the virus and sadly, some have died. in my view, with infections in ice detention facilities rising, alternatives to detention should be used for anyone not a threat to public safety,

is it homeland security or treasury agents? what departments are contributing agents to operation legend, and working in portland right now? guest: in operation legend, the general crime-fighting one, although there are several agencies involved the description was of it being led by the traditional law enforcement arm of the federal government, mainly the fbi. these are agencies within the department of justice that have long been assigned this kind of responsibility. i think there'll will be some from other agencies, and that bears watching. in portland, a very different answer. they appear to not have gotten the traditional agencies, but instead have brought in people from the department of homeland security, agencies that are farther away in their mission from traditional crime-fighting. and a wildcard in the mix is that one of the powers of the border control is to exercise various powers, including stopping people within 100 miles of the border. you might have seen stories about how legal definitions include the ocean. po

he is a member of the house homeland security committee.e is an active national guardsman who served nearly five years in the u.s. army and was a platoon leader in afghanistan. i worked in the press operations of the white house when homeland security was created. tom ridge was the first homeland security adviser before there was a department. if we compiled intel on journalists covering the agency, then congressman waxman would have hauled us up to congress with our attorneys and there would have been hell to pay. what can you do -- this would appear that dls only stopped the practice because they got caught. that's why they are targeting the journalists that reported on unclassified documents. what can you do that would hold what would appear to be an out of control agency at least to the norms and laws as we know them? >> you are 100% right. they have to be held accountable. when you consider the role and function of law enforcement, of which dls falls under the umbrella of, they have three roles and functions. the first is public safety

marshals, and the department of homeland security, hsi teams. to date, we have sent over 200 federal agents kansas city. we are directing a comparable number of agents to augment chicago's existing taskforces and we are providing an additional 35 agents to albuquerque. forunited states attorneys chicago, albuquerque, and kansas city are here today. these u.s. attorneys and the chief federal law enforcement officials in each of these cities are ultimately responsible for coordinating the ensuringffort and prosecutions from this initiative are effective. linked to this increase in federal law enforcement agents, we are also providing additional financial assistance to the state and local enforcement agent to permit them to provide more cops, more members of our task force. worksaid, federal agents hand in glove with state and local enforce -- law enforcement every day. we supplement and provide support to local law enforcement, but violent crime is ultimately a problem that will be solved by state and local leadership. asleadership in the cities,

was transferred to the department of homeland security in 2002 as part of the homedland security act. and like the secretary mentioned, we're responsible for the protection of public buildings and grounds that are owned, occupied or secured by the federal government. since may 28, we've observed over 425 demonstrations and 260 attacks at federal facilities across the country. these attacks include bullets fired at federal facilities, arson and objects thrown through windows. on may 29, at a federal facility in oakland, california, during a pretty violent demonstration, two of our protective security officers were shot a a drive-by shooting. one of those officers died of his injuries. in portland the county justice center has been under attack by demonstrators for the last 52 days. they paint that facility is painted every morning, it's been painted about 47 times in the last 52 days. directly adjacent to the justice center on one side to the north is the edith green -wendell wyatt federal building. one of our federal facilities we protect. to the north -- i'm sorry, to the south is th

>> david: i'm wondering whether this is homeland security. these are people in seattle to switch to a different city. you have armed antifa militia man if you want to call them that, militia men and women with walkie-talkies, the whole thing. it is like they are a small army that they have taken over the streets. what do you do particularly when you have mayors in portland, ted wheeler, he has a very progressive individual. there's nothing wrong with that. he's entitled to his opinions, but he's not taking any police action to secure the streets from innocent civilians. >> that is a good point, david. local politicians have the overall responsibility and authority to oversee the local police department. they are responsible for safeguarding their communities. if the local police department's are doing that, than those local officials are going to have to answer to their citizens. >> david: what happens in the meantime? we have a few minutes to go before the election in a few months passed out to the inauguration of a new mayor. frankly, mayor

specifically, federal statute states that the secretary of homeland security, and i'm quoting, shall otect buildings, grounds and property that are owned, occupied and secured by the federal government. the law goes on to state that the department can conduct investigations, again, i.a.p. quoting, on and off property in question, on offenses that may have been committed against property owned and occupied by the federal government or persons on that property. in other words, we are expressly allowed to leave federal property to conduct investigations and arrest individuals who have damaged federal property. we do this, of course, in conjunction with the department of justice. many of our law enforcement officers in portland have other responsibilities around the country. they are away from their families and putting their lives at risk every night. the smear attacks leveled against our officers is disgusting. as it relates to officers deployed in portland, these highly trained officers are in multicamouflageware because they work on the southwest border and they work in an environment

it's not the reason the department of homeland security was created. that's for sure. >> jeh johnson, you're a distinguished lawyer. what is the constitutional circumstance on this? because president trump now says he could do it in dozens of other cities? as far as i can tell, there's no violence. this is conjuring up some state of lawlessness in america that doesn't exist. can the president, in a sense, define an emergency and then act on what he describes as a self-defined emergency? >> fareed, i think that is fact-dependent. from what i can see, the facts don't really exist here. first and foremost, the mayor, the police chief, is principally responsible for public safety. and if they're not requesting federal help, then that calls into question what they are doing. if, in fact, there is a systematic violation of federal civil rights going on. say, for example, these agents are arresting people on less than probable cause, that is hugely problematic and may, indeed, violate federal law. as a general matter, federal law enforcement can protect feder
