and our evan perez is learning that special counsel jack smith is also adding to his team, experienced florida prosecutors. despite all of this, though, trump is standing firm tonight saying he will not give in on anybody calling him to suspend his presidential campaign. >> is there any circumstances under which you can see yourself dropping out of the 2024 presidential election? >> no, none whatsoever. >> i want to begin our coverage tonight with evan perez. he's in miami. evan, i mentioned the news that you broke about additions to jack smith's team. what more are you learning about that from the doj side? >> that's right, erin. we're expecting some seasoned lawyers from the u.s. attorney's office here in miami are going to be part of the team that will be handling this case going forward. we know that jack smith already has a couple of prosecutors from the office down here who joined his team. one of them is karen gilbert who, we're told, was part of the team that was getting ready or prepared the work for fbi agents to carry out that search last august in mar-a-lago. now, we know t

tonight he has been indicted when it comes to the special counsel jack smith's documents investigation. justice correspondent evan perez is following all this closely, all of this breaking news. evan, i know so far we have not heard from the justice department. we have heard from the former president, not only in several posts, but also nay video. what else are you learning about these charges? >>al well, kaitlan, i'm astonished really that the justice department really didn't seem to learn anything from last august, when the fbi conducted a search of mar-a-lago. and they said nothing for three days, allowing the former president to sort of set the narrative to frankly, you know, spin falsehoods about what happened during the search, calling the fbi thugs, making all kinds of claims about what occurred at mar-a-lago that day. it wasn't until, you know, threats were being made against fbi agents that the attorney general was finally persuaded by people around him to finally go out and say something. so, one of the things that i know certainly was being discussed at the justice department in recent weeks was if jack smit

cnn learns jack smith attended a meeting with trump's lawyers in washington, d.c. evan perezt do we know about this pool incident? seems fishy. >> it's one of the things prosecutors have been focusing on. they've been asking witnesses about this incident in october. sources telling kaitlan collins that there's an employee there at mar-a-lago who apparently drained the pool and the pool -- that caused a flooding inside the room where there's a server that holds surveillance equipment. the question that's driving these -- the question that prosecutors are raising is whether this was intentional? was this an attempt to try to damage surveillance equipment so they could not obtain and fill in gaps that they know exist or whether it was a complete accident? we know some of the testimony they received said it didn't damage the i.t. equipment here. obviously it's something that prosecutors are asking witnesses because they have been focussed on whether the -- again, part of the picture of obstruction that has been held over this entire investigation. >> what's really important here

perez. >> important reporting from evan and jamie. now we know that mark meadows has testified in both cases before special counsel jack smith. it appears that smith is getting closer in making a decision in recommending charges on the former president, questions about which front that would be on. dozens of people have testified before these grand juries. let's look at a few of the key witnesses with our senior legal analyst elie honition igen. let's start with evan corcoran, who not only wrote a lot, he recorded a lot after these meetings and all of those recordings, audio recordings, now in the hands of jack smith. >> he is an attorney. he was part of donald trump's legal team. a year ago in june of 2022. doj sent a subpoena saying we need all classified and sensitive government documents you may have at mar-a-lago. corcoran was directed by people within the trump team to this very important storage room where they were boxes of documents. he goes through the documents, pulled out 38 documents, hands them over to doj with a sworn certification that says we did our due diligence, this is all we have at mar-a-lago. turned ou

. >> cnn's evan perez and paula reed are outside the federal courthouse in miami right now. evan, you have new reporting on how special counsel jack smith ultimately decided to bring charges against trump in florida and not in washington, d.c. tell us more about that. >> that's right, jake. it's a decision certainly that surprised a lot of people, but i'm told that behind the scenes some of the preparations to do just that, to bring the case here in the southern district of florida, began taking shape several months ago. we know that one of the things jack smith's team had the benefit of was a miami-based prosecutor, her name is karen gilbert, she actually supervised the last case involving mar-a-lago, a chinese national who snuck her way into mar-a-lago back in 2019, when donald trump was still president. she helped oversee some of the steps before prosecutors carried out that extraordinary search that we saw of mar-a-lago last august, and so we know that behind the scenes, jake, the prosecution knew that the issue of venue was going to present itself. the fact is that mar-a-lago is down here, the former president left washington

perez, thank you so much. appreciate it. also in our law and justice lead today, we have some new exclusive cnn reporting that special counsel jacker president donald trump as part of his investigation into trump's handling or alleged mishandling of classified documents. the clips were provided to prosecutors by trump's legal team as well as at least from one other additional source. this revelation comes as the special counsel's office has begun producing the evidence in the classified documents case to trump's legal team as discovery, i believe, is what that's called. cnn's paula reid and elie honig are with us. paula, we knew about the one recording of trump from july 2021 at bedminster where he's talking about some document involving a potential attack on iran. he was meeting with a bunch of mark meadows autobiographer -- it's kind of a contradiction in terms. but some people helping mark meadows write his autobiography. what do we know about these other recordings? >> that's exactly right. we broke this story about that recording. and then it was included in the indictment. so last night when the special counsel revealed tha

perez. let's begin with meadows. a critical witness. who knows more than the man who is always around the man in the white house. we don't know if jack smith wanted classified documents or trying to overturn the election or both, right? >> right. we don't know, poppy. good morning, by the way. >> good morning. >> the fact is that, you know, based on what we've seen with other witnesses, prosecutors typically bring in witnesses and ask them about both matters. that's what we expect would have happened here. as you pointed out, mark meadows is arguably the biggest witness in both of these investigations. he was there when the former president was formulating his effort to try to stay in office despite losing the election. he was involved in trying to tell members of congress that there was this plan. you saw some of the text messages from the january 6 committee investigation. he outlined the plan and they took it. try to get states to send alternate electors and try to make sure that the former president could remain in office. we also know that obviously, he played a key role in the fact that prosecutors have this recording of trump

perez in washington. how damning is this evidence in the indictment? >> reporter: i think it was called a show-and-tell indictment, and that is exactly what the justice department has done, what jack smith's investigators have shown us pictures, trying to show us the carelessness with which they say the former president was treating some of these top secrets of the u.s. government. i'll read you some parts of what they described, the interactions between the former president and his attorney, evan corcoran who, as you remember, was forced by a judge to come in and have to testify. they pierced the attorney/client privilege, something that judges almost never do. but because they said that the justice department was able to prove that evan corcoran was part of essentially what was a crime fraud exception to that shield for attorney/client privilege, this is after the may 11, 2022 subpoena where the former president is being told he has to turn over these documents. i'll read you a part of what the justice department says. it's an interaction between the former president and evan corcoran. evan corcoran records all of this himself in notes contemporaneously. he says to evan corcoran
