you mentioned special counsel jack smith's two cases, and his having them dismissed.ust am wondering, leaving open the possibility that they could be reinstated once trump is no longer in the white house, do you expect those charges to be reinstated when trump leaves the office? and do you expect trump to pardon the people still involved with those cases? >> right. so just to clear things up. as you indicated. two different cases. the january 6th related prosecution at this point brought only against donald trump, although there were unindicted co-conspirators involved and it could be they might still be prosecuted at some future time. with respect to donald trump, right. jack smith moved to have the case dismissed without prejudice. judge chutkan granted that. it could be brought after donald trump is no longer president because olc office, office of legal counsel department of justice binding on jack smith requiring him to move to dismiss the case and only provides a temporary immunity while a president is a sitting president. now, that does not mean there wouldn't

as for jack smith, his investigation is over.ther he personally gets fired, you know, he's a department of justice employee, he could maybe have a job there. he will leave that investigation at the beginning of the trump term next year. the interesting question is what does congress want with him? what does congressman jordan, you know, that's -- there's an implicit threat there. >> right. can he be jailed? >> you know, as long as the rule of law exists in something like its current form there is no way you can imprison jack smith. however, what you could do is call him in to testify and there i would say to the republicans be careful what you ask for. because if jack smith has a forum to talk about these cases, i doubt it would go so well for president trump. >> the other question is will jack smith release a report putting evidence out there that he would have presented in court? >> yes, i think there's a certainty. in fact i'm sure what that office is doing now instead of preparing for trials they're preparing for the report.

there is no request by jack smith to dismiss as to those people., donald trump can pardon them, he can also just have direct his department of justice to dismiss the case. but because there are these two co-defendants in the mar-a-lago case, any report that is made public, with respect to that part of the case, under investigation, the florida case, will be severely redacted because they will not want to prejudice that criminal case against those two defendants, even if as everyone knows it is highly likely that donald trump will get rid of that part of the case. and so i think there will be a report, it will be highly . as to florida, i think we'll see a report as to the d.c. case. >> and what do you think happens, lisa, to walt nauta and dale rivera? >> i think they're going to be pardoned, particularly walt nauta, whose loyalty is unquestionable. you know that i have been to all four of the cases against former future president trump, that have been tried, and at all of them walt nauta was a presence, walt nauta doesn't go anywhere that donald t

it would have been jack smith going first. one wonders whether garland or fani willis would even have followed your thoughts. >> yeah, i think that's a good question. i think it is clear that the american public was not at all moved by alvin bragg's indictment, and even the trial and conviction in this hypothetical alternative timeline. for sure, jack smith would have indicted his cases before alvin bragg came down with his for sure he would have been. jack smith would have been the first one to get to trial. and would alvin bragg then have piled on his case on top of those? would fani willis have piled on her case on top of those? i guess we don't know. but i think by the weakest of the four cases, going first and being the only one to go to trial, that really undermined the entire process here, the entire effort to bring donald trump to accountability final observation from yours truly to those who say, well, garland could not have moved more quickly because he needed to watch the investigation by the house select committee.
