and this is again jackson. thisis the entirety of jackson's opinion . it's four paragraphs i stitched together, three lines from a second page but it's basically a one pager. and it's not one of the better-known pieces of jackson's acclaimed career but my argument here is it was truly big. for him and for his career and for the development of constitutional law since then which includes how the supreme court to this very day and later this month should think about reproductive rights. now robert h jackson you may know was not over his career and enthusiast for what we would call substantive due process. what what some would call more pejoratively judicial activism or living constitutionalism . think for instance of his concurring opinion in the railway express case where he explains the desirability of from the perspective of democratic theory of grounding decisions in the equal protection clause, exactly what douglas is doing in the skinner case because people protection leaves the political process a recourse if something isunequally unconstitutional

with all of that in mind, how is it that justice jackson now, ketanji brown jackson, will be able tobe re-establish some of that credibility? what will she bring to the table to help move the court in a better direction? more positive direction? >> well, i think her role as an individual is going to be very limited. obviously she's someone who's very skilled in coming together across coalitions. she's someone who i think may be able to find common cause with someone like justice gorsuch, more a libertarian on criminal justice issues. we've seen strange bed fellows on criminal justice issues. she is one of three in a liberal minority. it's going to be very hard for her by herself or overnight with the other two -- or even with the other two justices to overcome the wave that is being developed by the 6-3 conservative supermajority. numbers do not lie. six is twice three. >> eugene, let's get into the cases that they're going to be overseeing that they just announced in the next sessions. we are talking, of course, addressing election laws here, a win for the moment really for republic

congratulations justice ketanji brown jackson. i am very, very sorry. she is about to join the ranks of the losers whose job it is to lay out very clearly in pages that the supreme court justices themselves can't ignore what's happened. here's justice kagan today in the epa decision. she said the current court is textualist in being so suited. special cannons like the major questions doctrine, this is something that they made up. came to light in the ipa case and in this case coming up with the legislatures, magically appear as get out of text free cards. that's pretty out there. they were pretty out there in the roe decision. the institutional liberals that sit on the supreme court are actually warning us that as bad as things are been, they are getting worse really, really fast. as you mentioned, they are about to get worse for maybe our lifetime considering the age of these justices on the court now. >> you go to kavanaugh, this is somebody whose memorable quote is what goes around comes around and that i like beer and he essentially was threatening

i know you recently spoke to your friend, now justice jackson.e feel about joining the court at such a turbulent time? >> the most important thing is she is aware of the historic significance of her appointment to the court and i can't think of a better person to be joining the court in this moment to bring you important new perspectives that she will bring. she will do all of us proud. that being said, i am also aware that she is aware of what she is joining and that it is, i think it's fair to say, a very different course from the one in which she and i both clerked 22 years ago. it is a court now that is far more conservative, where her view, which would have very much have been in the main stream on the earlier court are now more likely to be consistently in the minority. but she is brilliant and she is wise and she will write great decisions, whether you carry the moment in real time or whether justice ginsberg in my court, she is writing dissent forages that will become full circle and the law of the land. >> no details and professor tyler

judge jackson will become justice jackson, the first black woman ever to serve on the supreme court in u.s. history. she was confirmed by the senate back in april. it was a bipartisan vote of 53 to 47 with three republicans voting in favor of the nomination. other republicans criticized jackson for not embracing regionalism and a narrow interpretation of the constitution and does not change the majority on the supreme court. she was a u.s. district court judge appointed by barack obama in 2014 and before that the u.s. and to the commission. and the prosecutor. justice breyer wrote he will step down at 9:00 a.m. after they release their last two rulings of the term they include president biden's attempt to shut down main and mexico which requires people to remain in mexico. the 83-year-old justice was appointed by president bill clinton in 1994 and a graduate of lowell high in san francisco, as well as, stanford university. at noon, and anna clark west coast time he will help the chief justice administer the oath of office to justice jackson. >> chris malone in washington. thank you. >>

brown at jackson is not just the 1st black woman on the corridor. there she is there, but she's also made the court now for the 1st time, a court that has 4 women for the 1st time ever and doesn't have a majority of white men. there are 4 white men on the court out of the 9 justices. and there is no diversity in terms of academic background. it concerns you. brown, jackson has gone to harvard university and harvard law school. all of the other justices went to elite ivy league institutions. but this will change or look at the court. what it won't change is the ideological mix. there are 6 conservative justices and because she replaces a conservative justice, it is $6.00 to $3.00 still. and those 6 to 3 decisions are what has gotten the court a good deal of criticism across the country, particularly the reversal of the right to abortion. that was removed last week. that means all 50 states and the territories get to decide for themselves whether abortion is legal or not. half of the states are said to reverse that, right? so there's been a lot of cri
