>> reporter: it could be big, jake.e came out of the search warrant that the southern district of new york did on michael cohen's office and hotel back in april, and -- and we know that the southern district got tens of thousands of documents, and it looks like this could be based on that. there could be various different potential federal crimes implicated here. first of all, if money was given in exchange for access to the administration, that's potentially a federal crime. it depends on how specific the understanding was, right? most people give money to an inaugural with some sort of favorable consideration, but if there's more of a specific quid pro quo, specific exchange understood, then we could have federal bribery statutes. also because the inaugural committee was a nonprofit, there could be crimes if some of that money was diverted out for improper uses, non- -- nonprofit uses, in which case they could have tax problems because non-profits obviously are tax-exempt, and if the money was being used for improper

president trump 47, jake. to democrats in congress 33. what do you make of it? >> i think people heard what the president said which is that he was going to own a shutdown for border security, for his border wall. he said that pretty clearly at a meeting carried on both live on television and in subsequent weeks that he was going to own this shutdown and that it would be something that he was in his words not mine proud to do. and listen. i think anything that the president does from here until this ends is going to be seen as a capitulation so a lot of republicans i have been talking to and we put it in playbook this morning said why doesn't he do it now in a holiday season instead of when nancy pelosi's speaker if he folds when she is speaker it is him folding to her. i could tell you that of the multitude of people i talked to on capitol hill, no one has any idea what the president's thinking or doing or has any clear insight into his strategy as the government again remains shut down more than a week. >> let's bring up the stats that we have on the longest g
