jana told her she accused norwood saying you are under suspicion. think she stole, which could provide the motive for the murder. the judge denied it saying it was here say and refused to allow her to testify what jana murray said to her. this is a setback for prosecutors. >> anytime we are talking about first degree murder and premeditation, the state must prove intent. that premeditation, deliberation and willfulness of an act. evidence that tends to support motive before the killing is critical to the prosecution. >> blood expert testified the blood spray on the wall and floor indicates jana murray was hit while standing, and crouching on the floor. she was not attacked in the bathroom where she was found tied up. the flow of blood from her forhead means she was standsing, not left lying on the floor for hours. a dna expert testified most of the afternoon. coming up at 6:00, we tell you where the dna points in this murder trial. that's the latest from the montgomery county courthouse. back to you. >> chris, thank you. >>> police in spots vain ya

the client killed jana murray and that norwood lost it during an argument. the stat's attorney has a different story and paul wagner has more live from rockville. >> reporter: the state's attorney believes this case was premeditated and that gina murray was lured to the store by norwood. but the defense attorney took a different position admitting that brittany norwood killed jana murray and that it was not planned as the prosecution claims. >> in this opening stage to the jury, he asked him to keep an open mind and counted the prosecution's claims that he planned the murder. norwood didn't lure him to the store. there was a horrific argument in the fight and grabbed stuff in reach and stupidly caused jana's death. wood never mentioned self- defense but said that the attempt to cover up was enent. she got involved in a nightmarish situation. her story was full of holes because there was no premeditation and state's attorney john mccarthy told the jury that she died at the hands of the woman who used eight weapons to inflict 323 wounds and there is evidence s

britney norwood is accused of killing her coworker jana murray last month and pal wagner has more on what is going on. >> reporter: this is why it's slow. there are over 140 jurors sitting in the third floor of the courthouse and they're not allowed to leave and they waiting ifar their turn to talk to the judge, the prosecution and defense. they answered yes to perhaps two, three questions and the judge wants ton if he can qualify them into a smaller pool. that could be 60 or 70 and then they will make their picks for the jury from there. >> reporter: the judgeel to the jury pool he wants five jurors and 12 alternates for a total of 17 people. to get to that number, the judge, prosecutors, and defense team have to weed up the people who have made up their minds or are disqualified. 38 people said they decided the guilt or inoness is of britney norwood. 18 people never heard of the case. as the potential jurors wait to speak to the judge, the curious, as well as people with great interest in the case, are stopping by to see the process for themselves. jana murray's college roommate, s

britney norwood is charged in the death of jana murray. we have the report. >> reporter: from amanda kramer, she's one of the evidence technician that is processed the scene after the crime. the jury was shown a screwdriver. the crime scene tech testified she found blood on the sink in the bathroom and what appeared to be blood in the kitchen sink. jurors were shown pictures taken inside jana murray's car. there was blood on the drive shift. also, a baseball cap with blood on the inner sweat band. prosecutors said norwood moved murray's car after the murder. on cross-examination, the defense raised issues, questions about evidence contamination. the box cutter and other tools were not individually bagged by the crime techs. they were all put together in a tool box raising the possibility clean objects were bloodied later. in their effort to prove premeditation, they put the alarm company on the stand. at the night of the murder, the store closed at 9:45 p.m. and reopened 20 minutes later at 10:05. britney norwood lured her back to the stor

crime scene photos showing the body of jana murray in opening statements. the defense said they're highly prejudicial, the state said they're essential to the case and the judge is trying to decide what to do about that. let's show you a video this we have and thosier sketches that we took a few months ago and there was a hearing. that shows some photos in a courtroom sketch. the state's attorney john mccarthy called the photos essential to the state's case and that the crime was premeditated. six to eight different weapons were used, hidden around the store. the defense attorney told the judge that we're going to be at a decided disvictim before the case begins. he went on to say that he's prejudicial to be flashing around gory pictures of the victims. judge robert greenberg a few minutes ago said while holding the photos that the photos were, quote, gruesome and he's concerned that the jury will immediately be disturbed and emotional. i can tell you that as i left the courtroom, the judge seemed to be leaning towards not allowing these photos to be used i

john mccarthy wanted to introduce an employee of lululemon who said she had a conversation with jana murray the night of the murder, she called her wanting to know if she sold brittany norwood any merchandise because she found merchandise in her bag, that is jana murray did and she didn't have a receipt for it and wanted to know if that was the case, if this woman had sold that merchandise to brittany norwood but the judge said that it was hearsay and he would not allow it, some of this testimony in court today was very graphic we want to warn you, that it may be upsetting to some viewers. >> reporter: in his opening statement to the jury last week states attorney john mccarthy never mentioned motive behind the attack it was the state's theory jana murray confronted brittany norwood but the jury never heard about it and never will. the phone conversation between murray and another employee is hearsay and cannot be admitted into evidence the state says the conversation took place the night of the murder when the jury took their seats the jury called to the stand a blood spatter expert

it has been seven months since jana murray was murdered. today britney norwood is charged in the case. 9 news reporter kristen fish soldier live in rockville with a preview. good morning. >> reporter: good morning. you know this is the first day of what is expected to be a two week-long, very high profile murder trial here in rockville. the defendant is of course 28-year-old britney norwood. she is accused of killing a coworker inside of the bethesda store last march. montgomery county prosecutors allege norwood beat murray to death. norwood then tried to cover-up the murder by playing the victim and telling police the two women had been attacked by two masked men inside the store. the murder the alleged cover- up, it rocked the bethesda community and soon the fate of britney norwood is going to be in the hands of 12 people. 12 jurors. this selection process starts this morning. attorneys are looking at a jury pool that will probably be in the hundreds of people. this is a case that received lots of national media attention, so many prospec

ktvu's jana katsuyama shows us what they did today in berkeley at the exact spot where their son was shot and killed by robbers a little more than one year ago. >> in the rain, adolfo seledon's mother stops in the middle of street and places a candle where her son was shot and killed. the family came from chile with a bit of flowers from their own garden. >> my son was a man of peace. >> reporter: the family says fido as they called him was -- >> he was shot before he died, far away from us. in the streets. >> reporter: seledon was walking home after a party about 3:40 in the morning. at adeline and emerson two robbers attacked him. shooting and killing seledon. it was his 35th birthday which he shared with his sister constansa. >> it is hard to believe we will not see him again, very hard. >> reporter: seledon's family says his family came hoping people here will help them. >> it's very sad for us. it's horrible. i'm not angry. i want justice. >> reporter: the suspect's descriptions are vague. police say that someone believes out there has information about this homicide. there is a

there was blood in jana murray's car. after killing murray, norwood left the store and drove murray's car, which was double parked outside. photos of a hammer and metal merchandise bar were showed to the jury. norwood used them on a fatal beating. the defense lawyer got the evidence technician to admit the items were not separately bagged but put together on a tool kit and blood could have been transferred from one to the other contaminating the evidence. prosecutors are asking the jury to find her guilty of first degree premeditated murder. the defense admits norwood killed jana murray, but says it was in a heated argument where she lost control and it was not premeditated. this case is expected to go to the jury next week. back to you in the studio. >> all right. chris gordon, thank you. pat? >>> a shooting at burger king in frederick has remained a mystery until now. police announced today they caught a suspect in a slaying last march. the burger king manager, a 32-year-old was discovered in the back of the restaurant.

jana katsuyama is live now at the scene of the robbery on mcarthur boulevard. jana, what did you learn about the incident tonight. >> reporter: we understand she was taken to the hospital with life threatening injuries the driver meanwhile went down mcarthur boulevard and he didn't get far before he crashed. >> oakland police approached the suspect's 1990lexus where their gunned drawn but they found the driver had already run off. the car had crashed down an enbankment to westbound 580. police quickly set up a perimeter and began the man hunt. police spread out searching the thick brush with dogs. the shooting happened ant two clock this -- about 2:00 this afternoon. woman say the woman was shot in the leg. >> people tell me she got out of the bank with her purse. she got her purse snatched and then she ran after the guy to the car and she got shot. >> reporter: police say they want to thank some citizens who saw the shooting and actually followed the robber's car. >> the citizens did follow the suspect and stood by. and waited until officers arrived on scene a
