let's go to janine de la vega live in atascadero. this is true janine? tell us about the little boy. >> reporter: just minutes ago police came to us and said they found him. this is very good news. we're going to get the scoop from the police chief himself. this is chief steve gisselle with atascadero police department. tell us what did you find out? >> reporter: we've been looking for little jeremy all day long today. we have over 100 volunteers and about 65, 70 law enforcement officers from across the country including the fbi: just minutes ago we received an update that apparently the suspect somehow garnered a cell phone and called police. apparently realizing that we were looking for her actively. and let us know where little jeremy was and he, he ended up being in an abandoned ford dealingship in town in atascadero. he was located there inside the building alone. he's now being medically cleared. >> reporter: do we know his condition or how he's doing? >> the word i have is he seems to be in good health and that's really. this just came across we'r

documents in the lab results that they say prove who killed 43-year-old janine harms. an hour and a half ago, the district attorney's office revealed what many people have suspected all along, that maureen killed her on july 27, 2001, and investigators were able to trace key fiber evidence from a rug in her home to his jeep cherokee. police believe he killed her at her home, then put hur body in the rug and disposed of it somewhere. he was arrested but in 2007, a judge dismissed the case against him when a criminalist was called into question. prosecutors did have the evidence reexamined, and now they say it is indeed the link to pin the murder on the man. when asked if the d.a. felt relief in closing the case, here's what he had to say. >> no, because he was never brought to justice. and because the sanchez-harms family suffered for many years waiting for answers as to what happened. >> wayne sanchez shot and killed the man at a san jose cafe in january, and then killed himself. police have never found janine's body. >> there is no better time for people who know what

ktvu's janine de la vega is live at atascadero on the latest on this developing story. >> reporter: ken that's right, 4-year-old jeremy guthrie has been found. he has been reunited with his mother in the last 30 minutes. we're told they're at the police department and that he seems to be okay. now in the last 30 minutes, we also heard that police arrested his alleged kidnapper 53-year- old annette hail in atascadero near an abandoned car dealership. police say hail got into an argument with jeremy's mother at a homeless shelter. when his mom woke up, jeremy was gone and she found a rambling note that led her to believe that hail had kidnapped him. volunteers held a massive search all day looking for hail and the boy. and shortly after 5:00 tonight, jeremy was found and hail was arrested. we're joined right now with rob brim from the atascadero police department. you're a spokesperson. tell me what is the latest, you were able to capture annette hail, how did you do that? >> i'm with the sheriff's office. we're here on mutual aid to help atascadero police. it was a huge effort by people

joining us now is the host of justice with janine judge jeanine pirro.cult case needless to say. murder charges, are they appropriate? >> well, first of all, what you have got here is a woman who is 26 years old. got a six week old infant. she does huge amounts of methamphetamine the night before. she breast feeds the baby, the baby literally do dies. she kills the baby through the meth in breast milk. is it murder? is it manslaughter or child abuse i come down on the side of the prosecution. >> murder? >> murder to be proven here. why? because there is evidence that her friends told her when you do meth, give the baby formula. other people told her the same thing. there was such malice and such conscious disregard for the life of this 6 week old infant she killed a baby. now, her lawyer says this is a poor woman who is a drug addicted person who is improffer irished native american. that's just great. she is not the victim. the 6 week old baby infant is a victim. it's time to make sure that these women who are doing this, another conviction in californi
